Let\u2019s take a look at how patents have allowed us to play ball!<!--more--><\/p>\n<p><strong>What is a Patent?<\/strong><\/p>\n<p>Patents are a form of intellectual property. They are issued by individual countries. In the United States, the United States Patent and Trademark Office (<a href=\"https:\/\/www.uspto.gov\/about-us\">USPTO<\/a>) grants patents to patent applications that meet the relevant criteria. A patent gives the owner\u2014whether the original inventor, or someone the inventor assigns his\/her rights to (such as an employer)\u2014the right to exclude others from \u201c<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/154\">making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States<\/a>.\u201d The right generally <a href=\"https:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/s2701.html\">lasts<\/a> for 20 years from the time the application for the patent is filed, but does not begin until the patent actually issues.<\/p>\n<p>In the U.S., patents are issued for products and processes as long as they are new, useful, and nonobvious. Certain things are <a href=\"https:\/\/www.bitlaw.com\/source\/mpep\/2106_04_b.html\">barred<\/a> from being patented, such as natural phenomena, laws of nature, and abstract ideas.<\/p>\n<p><a href=\"https:\/\/www.law.cornell.edu\/wex\/intellectual_property_clause\">Article I, Section 8, Clause 8 of the U.S. Constitution<\/a> grants the government power to issue patents. One justification for issuing patents is to reward the inventor for providing something useful to society by awarding a limited monopoly. This limited monopoly may be used to incentivize inventors to continue to make advancements in their respective fields.<\/p>\n<p><!--more--><\/p>\n<p><strong>Let\u2019s Play Catch<\/strong><\/p>\n<p>An essential piece of equipment to baseball players today is the baseball glove. At first, gloves were considered <a href=\"https:\/\/www.smithsonianmag.com\/arts-culture\/the-invention-of-the-baseball-mitt-12799848\/\">\u201cunmanly\u201d<\/a> and therefore not worn by early players, leaving them with bruised hands and broken fingers. Over time this stigma was broken and glove technology began to evolve.<img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-691 alignright\" src=\"http:\/\/blogs.luc.edu\/ipbytes\/files\/2020\/04\/Base-Ball-Catcher-232x300.jpg\" alt=\"\" width=\"232\" height=\"300\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Base-Ball-Catcher-232x300.jpg 232w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Base-Ball-Catcher.jpg 510w\" sizes=\"auto, (max-width: 232px) 100vw, 232px\" \/><\/p>\n<p>One of the first patents on a baseball glove was granted to George Rawl<span style=\"font-size: 1rem;\">ings in 1885 (<\/span><a style=\"font-size: 1rem;\" href=\"https:\/\/patents.google.com\/patent\/US325968A\/en?oq=us+325968\">Pat. No. 325,968<\/a><span style=\"font-size: 1rem;\">). The glove looked very similar to a typical everyday glove, and not like the baseball mitts used today. Advancements were made in 1891 by Harry Decker (<\/span><a style=\"font-size: 1rem;\" href=\"https:\/\/patents.google.com\/patent\/US450366A\/en?oq=us+450366\">Pat. No. 450,366<\/a><span style=\"font-size: 1rem;\">) and Bob Reach <\/span><a style=\"font-size: 1rem;\" href=\"https:\/\/patents.google.com\/patent\/US450717A\/en?oq=us+450717\">(Pat. No. 450,717<\/a><span style=\"font-size: 1rem;\">) by adding cushioning to the gloves. The classic \u201cpillow-style\u201d catcher\u2019s mitt came about in 1895 (<\/span><a style=\"font-size: 1rem;\" href=\"https:\/\/patents.google.com\/patent\/US528343A\/en?oq=us+528343\">Pat. No. 528,343<\/a><span style=\"font-size: 1rem;\">).<\/span><\/p>\n<p>One of the more bizarre patents on catching equipment\u00a0came in 1904. James Bennet created the \u201cBase Ball Catcher\u201d (<a href=\"https:\/\/patents.google.com\/patent\/US755209A\/en?oq=us+755209\">Pat. No. 755,209<\/a>). This catching apparatus worked by strapping a cage to the front of one\u2019s torso and acting as a target to catch the ball. Imagine catchers wearing a cage while squatting behind a batter . . . needless to say, the invention struck out.<\/p>\n<p><!--more--><\/p>\n<p><strong>Batter Up!<\/strong><\/p>\n<p>Bats have remained relatively unchanged from the early days of baseball. In 1884, William Gray obtained a patent for a baseball bat with a roughened handle to help with a batter\u2019s grip (<a href=\"https:\/\/patents.google.com\/patent\/US300360A\/en?oq=us+300360\">Pat. No. 300,360<\/a>).<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-693 alignleft\" src=\"http:\/\/blogs.luc.edu\/ipbytes\/files\/2020\/04\/Curved-Bat-261x300.jpg\" alt=\"\" width=\"261\" height=\"300\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Curved-Bat-261x300.jpg 261w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Curved-Bat.jpg 456w\" sizes=\"auto, (max-width: 261px) 100vw, 261px\" \/>As the founder of Hillerich &amp; Bradsby Co., the manufacturer of the <a href=\"https:\/\/www.sluggermuseum.com\/about-us\/our-history\">Louisville Slugger<\/a>, John Hillerich owned many patents on baseball bats. One such patent was on a process of hardening the surface of a bat to allow for balls to be hit much longer distances (<a href=\"https:\/\/patents.google.com\/patent\/US716541A\/en?oq=us+716541\">Pat. No. 716,541<\/a>). Another patent, which did not get incorporated into the modern game, was a bat with a textured barrel to modify the direction of a batted ball (<a href=\"https:\/\/patents.google.com\/patent\/US771247A\/en?oq=us+771247\">Pat. No. 771,247<\/a>). Yet another strange patent that is not featured in today\u2019s game was the curved bat (<a href=\"https:\/\/patents.google.com\/patent\/US430388A\/en?oq=us+430388\">Pat. No. 430,388<\/a>). The bat included a large curve near the end of the barrel to put greater spin on a batted ball.<\/p>\n<p><strong>You\u2019re Out!<\/strong><\/p>\n<p>Before the debate about using an <a href=\"https:\/\/www.cbssports.com\/mlb\/news\/robot-umpires-how-it-works-and-its-effect-on-players-and-managers-in-the-atlantic-league-plus-whats-to-come\/\">electronic strike zone<\/a> started, patents were granted on technologies designed to aid umpires. In 1875, John C. O\u2019Neil patented a base with a bell (<a href=\"https:\/\/patents.google.com\/patent\/US171038A\/en?oq=us+171038\">Pat. No. 171,038<\/a>). As the base runner would step on the base, the bell would ring providing an auditory signal for the umpire to <img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-692 alignright\" src=\"http:\/\/blogs.luc.edu\/ipbytes\/files\/2020\/04\/Base-Bell-300x169.jpg\" alt=\"\" width=\"300\" height=\"169\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Base-Bell-300x169.jpg 300w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2020\/04\/Base-Bell.jpg 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><span style=\"font-size: 1rem;\">use to determine if the runner was safe or out. Expanding on this idea, John M. Humphreys patented an electronic base system in 1903 (<\/span><a style=\"font-size: 1rem;\" href=\"https:\/\/patents.google.com\/patent\/US727633A\/en?oq=us+727633\">Pat. No. 727,633<\/a><span style=\"font-size: 1rem;\">). The system included a series of circuits set up across the infield but was too technologically complicated to be adopted by the league.<\/span><\/p>\n<p><!--more--><\/p>\n<p><strong>Rounding Third, Heading for Home\u2026<\/strong><\/p>\n<p>Although some patents were clearly a swing and a miss, as you can see, patents have always played a part in our national pastime. This will continue to be true as baseball evolves during the technology age, where decisions are driven more and more by <a href=\"https:\/\/www.forbes.com\/sites\/leighsteinberg\/2015\/08\/18\/changing-the-game-the-rise-of-sports-analytics\/#15d2fb7c4c1f\">analytics<\/a>.
