{"id":4843,"date":"2025-03-24T21:08:15","date_gmt":"2025-03-24T21:08:15","guid":{"rendered":"https:\/\/blogs.luc.edu\/ipbytes\/?p=4843"},"modified":"2025-03-24T22:01:40","modified_gmt":"2025-03-24T22:01:40","slug":"securing-sisterhood-my-first-introduction-to-ip","status":"publish","type":"post","link":"https:\/\/blogs.luc.edu\/ipbytes\/securing-sisterhood-my-first-introduction-to-ip\/","title":{"rendered":"Securing Sisterhood: My First Introduction to IP"},"content":{"rendered":"<p>Since 2022, I have proudly worn the symbols of <a href=\"https:\/\/www.deltasigmatheta.org\/\">Delta Sigma Theta Sorority, Incorporated (Delta)<\/a>. Delta is a Black Greek Letter Organization committed to sisterhood, scholarship, public service, and social action.<\/p>\n<p>Before law school enrollment, I noticed a \u201c\u00ae\u201d symbol on my Delta crewneck. Now, I\u2019ve noticed this symbol on things like <a href=\"https:\/\/www.stanley1913.com\/\">Stanley Cups<\/a>. But what would it have to do with my public service sorority? During my law school admissions journey, I discovered <a href=\"https:\/\/www.wipo.int\/about-ip\/en\/\">intellectual property law (IP)<\/a> which led me to realize its relation to the \u201c\u00ae\u201d symbol.<\/p>\n<p><strong>An Invitation to IP at Loyola <\/strong><\/p>\n<p>I was tempted to stay in the South for law school. However, an acceptance to <a href=\"https:\/\/www.luc.edu\/law\/\">Loyola University Chicago School of Law (Loyola)<\/a> piqued my interest. As an Atlanta native and proud <a href=\"https:\/\/www.uga.edu\/\">Georgia Bulldog<\/a>, moving to Chicago was a big leap. I was unsure if I could adjust to the Midwest and what my legal career would look like. Little did I know one reception invitation would make my law school journey clearer.<\/p>\n<p>I attended <a href=\"https:\/\/www.lawalumni.luc.edu\/s\/1548\/law\/index.aspx?sid=1548&amp;gid=3&amp;pgid=7965&amp;content_id=8595\">Loyola\u2019s IP Alumni\/Student Reception<\/a> and Admitted Students Day in April 2024. I learned about <a href=\"https:\/\/www.patenttrademarkblog.com\/patent-prosecution\/\">patent prosecution<\/a>, which is the handling of patent applications with the <a href=\"https:\/\/www.uspto.gov\/\">US Patent and Trademark Office (USPTO)<\/a>. Unfortunately, I do not hold a STEM degree required to qualify for the patent \u201cbar\u201d to practice before the USPTO. Fortunately, IP law does not stop there. I learned that <a href=\"https:\/\/abounaja.com\/blog\/intellectual-property-litigation#:~:text=Intellectual%20property%20litigation%20refers%20to,lawsuit%20against%20the%20infringing%20party.\">IP litigation<\/a> in federal courts does not require a STEM background. IP litigators handle legal disputes over intellectual property rights. I was even introduced to this <a href=\"https:\/\/blogs.luc.edu\/ipbytes\/\">IP Bytes blog<\/a>!<\/p>\n<p>I walked away from the reception with winter coat suggestions and inspiration. I was set on Loyola and a legal career in IP. I paid my seat deposit that evening.<\/p>\n<p><strong>Talking Trademarks<\/strong><\/p>\n<p>Following the reception, I was on a mission to spot IP everywhere, including in my sorority. As I learned from another <a href=\"https:\/\/blogs.luc.edu\/ipbytes\/very-demure-very-mindful-very-trademarkable-can-tiktok-catchphrases-be-trademarked\/\">IP bytes post<\/a> by Emma Welch, a trademark can be a word, symbol, or design that identifies and distinguishes the source of goods or services.<\/p>\n<figure id=\"attachment_4847\" aria-describedby=\"caption-attachment-4847\" style=\"width: 226px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4847 size-medium\" src=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2025\/03\/dst-226x300.jpg\" alt=\"\" width=\"226\" height=\"300\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2025\/03\/dst-226x300.jpg 226w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2025\/03\/dst-68x90.jpg 68w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2025\/03\/dst.jpg 436w\" sizes=\"auto, (max-width: 226px) 100vw, 226px\" \/><figcaption id=\"caption-attachment-4847\" class=\"wp-caption-text\"><em>Photo attributed to Kendall Henry.<\/em><\/figcaption><\/figure>\n<p>That means the \u201c\u00ae\u201d symbol I noticed on my crewneck indicated a <a href=\"https:\/\/www.inta.org\/fact-sheets\/trademark-symbols\/\">registered trademark<\/a>! Delta indeed owns <a href=\"https:\/\/deltasigmatheta.org\/wp-content\/uploads\/2021\/05\/Delta-Sigma-Theta-Sorority-Inc..-SCHEDULE-A-U.S.-Registered-Trademarks-.pdf\">several marks<\/a>, such as \u201cDelta Sigma Theta\u201d and its Greek letter form, &#8220;\u0394\u03a3\u0398.&#8221;<\/p>\n<p>The membership and those with vendor licenses from the sorority have <a href=\"https:\/\/www.deltasigmatheta.org\/licensing-merchandising\/\">permitted use<\/a> of Delta&#8217;s marks. As such, these trademarks can be found on paraphernalia such as hats, jackets, and scarves. Delta permits the exclusive use of paraphernalia by members and for sale by licensed vendors.<\/p>\n<p>On the other hand, <a href=\"https:\/\/www.uspto.gov\/page\/about-trademark-infringement#:~:text=Trademark%20infringement%20is%20the%20unauthorized,the%20goods%20and%2For%20services.\">unauthorized use<\/a> of Delta&#8217;s marks can lead to legal action. The sorority strives to resolve these issues without litigation. However, it has successfully obtained <a href=\"https:\/\/www.law.cornell.edu\/wex\/injunctive_relief\">injunctive relief<\/a> against infringers, terminating the improper use.<\/p>\n<p><strong>Marks of Honor<\/strong><\/p>\n<p>So, what is the importance of Delta\u2019s trademarks? I haven&#8217;t officially studied trademarks yet, but let me tell you my thoughts. Delta&#8217;s marks are for brand protection and to limit confusion. For example, many other Greek organizations beginning with Delta, such as <a href=\"https:\/\/www.deltasigmapi.org\/\">Delta Sigma Pi<\/a>, can cause a mix-up of who is who.<\/p>\n<p>However, Delta\u2019s rich history and reputation are why distinction is essential. The Founders were among the few Black women to participate in the <a href=\"https:\/\/archivesfiles.delaware.gov\/online-exhibits\/delta-sigma-theta\/suffrage-march.html\">March for Women\u2019s Suffrage<\/a> in 1913. Today, the sorority remains a beacon for <a href=\"https:\/\/www.deltasigmatheta.org\/social-action-center\/\">social action<\/a> and progress in the Black community. Notable members such as <a href=\"https:\/\/www.womenshistory.org\/education-resources\/biographies\/shirley-chisholm\">Shirley Chisholm<\/a>, <a href=\"https:\/\/supremecourthistory.org\/supreme-court-justices\/associate-justice-ketanji-brown-jackson\/\">Supreme Court Justice Ketanji Brown Jackson<\/a>, and <a href=\"https:\/\/www.fjc.gov\/history\/judges\/williams-ann-claire\">Judge Ann Claire Williams<\/a> have upheld these ideals.<\/p>\n<p>Delta Sigma Theta Sorority, Incorporated is Black history. It is an esteemed honor to bear those symbols. For these reasons, protecting Delta&#8217;s brand is of the utmost importance. Intellectual property rights help make that possible.<\/p>\n<p>Without the alumni reception at Loyola, I may never have taken an interest in IP and surely would not have spotted its critical role in my sorority. Now, as a first-year law student, I have joined the<a href=\"https:\/\/www.luc.edu\/law\/studentlife\/organizations\/intellectual\/\"> Intellectual Property Law Society<\/a> and gained an excellent mentor, <a href=\"https:\/\/www.linkedin.com\/in\/emily-moll-085938a3\/\">Emily Moll<\/a>.<\/p>\n<p>IP at Loyola has given me many opportunities to grow professionally and appreciate my interests.<\/p>\n<p>This is just the beginning! I am excited to take an intellectual property course next semester.
