{"id":3372,"date":"2024-02-18T12:23:08","date_gmt":"2024-02-18T17:23:08","guid":{"rendered":"https:\/\/blogs.luc.edu\/ipbytes\/?p=3372"},"modified":"2024-07-31T05:13:10","modified_gmt":"2024-07-31T05:13:10","slug":"palatable-patents","status":"publish","type":"post","link":"https:\/\/blogs.luc.edu\/ipbytes\/palatable-patents\/","title":{"rendered":"Palatable Patents"},"content":{"rendered":"<p>Did you know that many of the food products you see on the shelf at the grocery store are patented?<\/p>\n<p><a href=\"https:\/\/www.investopedia.com\/terms\/u\/utility-patent.asp\">Utility patents<\/a> are granted by the United States Patent and Trademark Office (<a href=\"https:\/\/www.uspto.gov\/\">USPTO<\/a>) for useful \u201cinventions\u201d that are <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/102\">new<\/a> and <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/103\">nonobvious<\/a>. The owner of a utility patent has the right to <a href=\"https:\/\/www.bitlaw.com\/patent\/rights.html\">exclude<\/a> others from making, selling, offering to sell, using, or importing the patented invention for a set period of time\u2014usually around 17 years.<\/p>\n<p><!--more--><\/p>\n<figure id=\"attachment_4444\" aria-describedby=\"caption-attachment-4444\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4444 size-medium\" src=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture1-300x201.jpg\" alt=\"\" width=\"300\" height=\"201\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture1-300x201.jpg 300w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture1-768x514.jpg 768w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture1-134x90.jpg 134w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture1.jpg 904w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-4444\" class=\"wp-caption-text\"><em>Photo by Jonathan Borba, licensed under Unsplash.<\/em><\/figcaption><\/figure>\n<p><!--more--><\/p>\n<p><strong>Scrumptious Subject Matter<\/strong><\/p>\n<p>The USPTO considers four categories of subject matter as \u201c<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/35\/101\">inventions<\/a>\u201d for utility patents: (1) processes (2) machines (3) manufactures and (4) compositions of matter. <a href=\"https:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/s2106.html\">Compositions of matter<\/a> can include a mixture of two or more ingredients, such as ingredients used to form food products.<\/p>\n<p>There are some <a href=\"https:\/\/www.uspto.gov\/ip-policy\/patent-policy\/patent-subject-matter-eligibility\">exceptions<\/a>. Based on <a href=\"https:\/\/www.brettoniplaw.com\/patentable%20subject%20matter%20and%20judicial%20exceptions.html\">judicial interpretation<\/a>, abstract ideas, natural phenomena (including products of nature), and laws of nature are not eligible for patent protection. So, a wild strawberry that is found in a bush in the wild can\u2019t be patented as a natural phenomenon. But if you pick that strawberry off the bush, mix it up with some other ingredients, and make something like a <a href=\"https:\/\/patents.google.com\/patent\/US8486469B2\/en\">low-calorie food bar<\/a>, can you apply for a patent on that invention? See below for some examples.<\/p>\n<ul>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US10874121B2\/en\">Beverages<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US9241506B2\/en\">Cereals and other grain products<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US8609164B2\/en\">Dairy products and substitutes<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US6491960B1\/en\">Desserts<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US5102680A\/en\">Dessert toppings and fillings<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US10874121B2\/en\">Fruits and fruit juice<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US4399156A\/\">Mixed dishes<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US6039999A\/\">Nuts and seeds<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US4148929A\/en\">Salads<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US6942886B2\/\">Sugars and sweets<\/a><\/li>\n<li><a href=\"https:\/\/patents.google.com\/patent\/US4006256A\/\">Vegetables<\/a><\/li>\n<\/ul>\n<p><!--more--><\/p>\n<p><strong>Yummy Utility<\/strong><\/p>\n<p>If utility patents are granted for useful inventions, what is the usefulness claimed by the inventors of food patents? Let\u2019s explore patents directed to improving the functionality, nutrition, and flavor of food products.<\/p>\n<p><em>Function<\/em><\/p>\n<p>The use of many patented food products goes above and beyond providing sustenance. Some patented food products are directed to improving functionality of a food item. For example, <a href=\"https:\/\/patents.google.com\/patent\/US8703220B2\/\">U.S. Patent No. 8,703,220<\/a> titled \u201cShaped-potato sandwich product\u201d addresses the mess and waste of placing a pile of french fries on a sandwich. The patented invention describes a \u201cpre-made french fry potato sandwich garnish\u201d designed to eliminate such struggle. These novel tortillas are designed to reduce difficulties in folding, holding, and sealing fillings into tortillas.<\/p>\n<figure id=\"attachment_4441\" aria-describedby=\"caption-attachment-4441\" style=\"width: 300px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4441 size-medium\" src=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture4-300x251.png\" alt=\"\" width=\"300\" height=\"251\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture4-300x251.png 300w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture4-108x90.png 108w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture4.png 715w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-4441\" class=\"wp-caption-text\"><em>U.S. Patent No. 10,785,985 (filed Sept. 4, 2014).<\/em><\/figcaption><\/figure>\n<p><em>Nutrition<\/em><\/p>\n<p>In some cases, the use of a patented food product is an improvement in nutrition. A Chinese health product company owns such a patent for infant and toddler food. <a href=\"https:\/\/patents.google.com\/patent\/US9414618B2\/\">U.S. Patent No. 9,414,618<\/a> covers infant formula milk powder capable of preventing and alleviating infant iron deficiency anemia.<\/p>\n<p>In other cases, patent holders have sought to patent healthy snacking options. <a href=\"https:\/\/patents.google.com\/patent\/US11540553B2\/\">U.S. Patent No. 11,540,553<\/a> owned by Mars. Inc. describes \u201cLegume-based food products.\u201d These savory snacks have an outer, crispy shell and an inner, creamy filling. The filled pillows offer a desirable nutritional profile by the use of legumes and additives such as vitamins and minerals.<\/p>\n<figure id=\"attachment_4440\" aria-describedby=\"caption-attachment-4440\" style=\"width: 435px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4440\" src=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5-300x151.png\" alt=\"\" width=\"435\" height=\"219\" srcset=\"https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5-300x151.png 300w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5-1024x515.png 1024w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5-768x386.png 768w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5-179x90.png 179w, https:\/\/blogs.luc.edu\/ipbytes\/wp-content\/uploads\/2024\/02\/Picture5.png 1093w\" sizes=\"auto, (max-width: 435px) 100vw, 435px\" \/><figcaption id=\"caption-attachment-4440\" class=\"wp-caption-text\"><em>Legume-based filled pillow products of U.S. Patent No. 11,540,553 (filed Jan. 18, 2019).<\/em><\/figcaption><\/figure>\n<p><em>Flavor<\/em><\/p>\n<p>Other patented foods are designed to improve taste or flavor of a food product. For instance, Life Savers Inc. holds expired <a href=\"https:\/\/patents.google.com\/patent\/US4301178A\/\">U.S. Patent No. 4,301,178<\/a> titled \u201cLiquid-filled chewing gum.\u201d The claimed chewing gum encases a releasable liquid sweetener that promotes immediate flavor release.<\/p>\n<p>In another example, Lotte, a Japanese snack food company, holds expired <a href=\"https:\/\/patents.google.com\/patent\/US5681605A\/\">U.S. Patent No. 5,681,605.<\/a> The patent describes drawbacks with the taste and feel when pre-filled hollow pretzel rods are baked simultaneously with their filling. To overcome this problem, the inventors came up with a hollow, cylindrical pretzel that allows separate preparation of a pretzel rod and its filling.
