{"id":616,"date":"2020-09-05T22:55:43","date_gmt":"2020-09-05T22:55:43","guid":{"rendered":"http:\/\/blogs.luc.edu\/edlawinstitute\/?p=616"},"modified":"2020-09-05T22:55:43","modified_gmt":"2020-09-05T22:55:43","slug":"unconnected-students-who-were-left-without-instruction-during-covid-19-by-timothy-higus","status":"publish","type":"post","link":"https:\/\/blogs.luc.edu\/edlawinstitute\/unconnected-students-who-were-left-without-instruction-during-covid-19-by-timothy-higus\/","title":{"rendered":"UNCONNECTED: Students Left Without Instruction During COVID-19, by Timothy Higus"},"content":{"rendered":"<p><span data-contrast=\"auto\">The public health crisis resulting from COVID-19 thrust v<\/span><span data-contrast=\"auto\">irtually all schools, teachers, and students into a world that relied on remote access to education, and it became clear that a significant number of students were left unconnected<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">The Widening Homework Gap<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Some astonishing findings have been published over the last several years regarding the\u00a0<\/span><span data-contrast=\"auto\">\u201c<\/span><a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2019\/05\/07\/digital-divide-persists-even-as-lower-income-americans-make-gains-in-tech-adoption\/\"><span data-contrast=\"none\">digital divide<\/span><\/a><span data-contrast=\"auto\">\u201d (American\u2019s unequal access to technology)<\/span><span data-contrast=\"auto\">\u00a0and the\u00a0<\/span><span data-contrast=\"auto\">\u201c<\/span><a href=\"https:\/\/www.theatlantic.com\/education\/archive\/2018\/10\/lacking-internet-millions-teens-cant-do-homework\/574402\/\"><span data-contrast=\"none\">homework gap<\/span><\/a><span data-contrast=\"auto\">\u201d (the inability for students to do homework without technology).<\/span><span data-contrast=\"auto\">\u00a0In 2017, as part of the Every Student Succeeds Act requirements, the\u00a0<\/span><a href=\"https:\/\/nces.ed.gov\/pubs2017\/2017098\/index.asp\"><span data-contrast=\"none\">National Center for Education Statistics found<\/span><\/a><span data-contrast=\"auto\">\u00a0that students living at or below the poverty threshold and students who are American Indian, Black, Hispanic, or living in a rural area have significantly less home-access to technology. <\/span><\/p>\n<p><span data-contrast=\"auto\">Most people cited the expense of broadband as the primary barrier to access or that their family did not need or have an interest in access. Rural students reported difficulty getting <img loading=\"lazy\" decoding=\"async\" class=\" wp-image-617 alignright\" src=\"http:\/\/blogs.luc.edu\/edlawinstitute\/files\/2020\/09\/john-schnobrich-yFbyvpEGHFQ-unsplash-300x189.jpg\" alt=\"\" width=\"397\" height=\"250\" \/>access to fixed broadband service. In 2018, the\u00a0<\/span><a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2020\/03\/16\/as-schools-close-due-to-the-coronavirus-some-u-s-students-face-a-digital-homework-gap\/\"><span data-contrast=\"none\">Pew Research Center found<\/span><\/a><span data-contrast=\"auto\">\u00a0that the majority of eighth-grade students rely on connected technology to complete their homework and that approximately seventeen percent of students said they were unable to complete their homework because of a lack of home internet access. The U.S. Senate\u2019s\u00a0<\/span><a href=\"https:\/\/www.jec.senate.gov\/public\/_cache\/files\/ff7b3d0b-bc00-4498-9f9d-3e56ef95088f\/the-digital-divide-.pdf\"><span data-contrast=\"none\">Joint Economic Committee<\/span><\/a><span data-contrast=\"auto\">\u00a0found that nearly 12 million students were living in homes without access to broadband in 2017.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This problem worsened when in-person learning was suspended. Delivering instruction remotely to students\u00a0<\/span><a href=\"https:\/\/www.edweek.org\/ew\/articles\/2020\/04\/10\/the-disparities-in-remote-learning-under-coronavirus.html\"><span data-contrast=\"none\">without access<\/span><\/a><span data-contrast=\"auto\"> to technology was one of, if not the most, challenging components of remote instruction for teachers and students. Although the homework gap existed before the school closures, the disparity became much worse during remote learning because of the increased reliance on web-based communication and assignments. Some school districts were not able to develop online lessons and instead sent home <\/span><a href=\"https:\/\/www.wired.com\/story\/school-online-digital-divide-grows-greater\/\"><span data-contrast=\"none\">packets<\/span><\/a><span data-contrast=\"auto\">\u00a0of paper learning materials or recordings of lectures on DVDs or flash drives. Even in districts where a substantial number of students were connected, many school leaders faced difficult equity issues around providing some students with synchronous, online instruction while other students were left to work through self-guided packets.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">State and Local Efforts<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Surprisingly, private Internet Service Providers\u00a0<\/span><span data-contrast=\"none\">(\u201cISP\u201d) and telecom companies<\/span><span data-contrast=\"auto\"><a href=\"https:\/\/slate.com\/technology\/2020\/03\/coronavirus-school-broadband-homework-gap.html\"> offered significant help<\/a> while schools were closed. Many telecom companies provided mobile hotspots to students and schools at no or reduced cost to keep students connected anywhere they can get a phone signal. Private ISPs also helped keep students online by lowering or eliminating their costs of service for fixed broadband service. Unfortunately though, these special offers were often limited to \u201c<\/span><a href=\"https:\/\/www.nytimes.com\/2020\/05\/20\/technology\/coronavirus-broadband-discounts.html\"><span data-contrast=\"none\">low-income<\/span><\/a><span data-contrast=\"auto\">\u201d households where the family had\u00a0<\/span><a href=\"https:\/\/www.businessinsider.com\/charter-spectrum-free-internet-wifi-families-unpaid-bills-blocked-offer-2020-4\"><span data-contrast=\"none\">no outstanding previous balance<\/span><\/a><span data-contrast=\"auto\">\u00a0with the company. These conditions created an obstacle for many families seeking an equitable education for their children.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Many school districts took it upon themselves to keep students connected. A number of schools distributed one-to-one devices so students had a device at home. Schools also found\u00a0<\/span><a href=\"https:\/\/www.newamerica.org\/oti\/blog\/homework-gap-leaves-students-further-behind-during-public-health-crisis-policymakers-should-act-immediately\/\"><span data-contrast=\"none\">creative ways\u00a0<\/span><\/a><span data-contrast=\"auto\">to mitigate the connectivity problem such as sending mobile hotspots on buses into the community or distributing mobile hotspots directly to students. Some even found a way to emit a Wi-Fi signal over TV whitespace. These solutions may have been sufficient for a short-term emergency<\/span><span data-contrast=\"auto\">\u00a0but will likely not be sustainable over a long period. Because there is a reasonable likelihood that schools will be doing some sort of\u00a0<\/span><span data-contrast=\"none\">remote learning throughout the Fall<\/span><span data-contrast=\"auto\">\u00a0and that the homework gap will exist after, as it did before the school closure, schools will need permanent solutions to the connectivity problems faced by many students.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">All fifty states<\/span><span data-contrast=\"auto\">\u00a0have created some type of task force, commission, or authority to coordinate broadband expansion. While these committees are charged with identifying problems and creating solutions for broadband access state-wide, several states stand out as\u00a0<\/span><a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/R\/R46307\"><span data-contrast=\"none\">models<\/span><\/a><span data-contrast=\"auto\">\u00a0for broadband expansion. Efforts that some states have already taken to improve infrastructure include\u00a0<\/span><a href=\"https:\/\/nysbroadband.ny.gov\/\"><span data-contrast=\"none\">appropriating grant money<\/span><\/a><span data-contrast=\"auto\">\u00a0for broadband infrastructure,\u00a0<\/span><a href=\"https:\/\/www.bbcmag.com\/breaking-news\/new-public-private-partnership-to-boost-broadband-in-southeastern-new-mexico\"><span data-contrast=\"none\">partnering with private industry<\/span><\/a><span data-contrast=\"auto\">\u00a0to subsidize infrastructure in difficult <img loading=\"lazy\" decoding=\"async\" class=\" wp-image-618 alignleft\" src=\"http:\/\/blogs.luc.edu\/edlawinstitute\/files\/2020\/09\/nasa-Q1p7bh3SHj8-unsplash-300x200.jpg\" alt=\"\" width=\"362\" height=\"241\" \/>service areas, and installing\u00a0<\/span><a href=\"https:\/\/azgovernor.gov\/governor\/news\/2020\/01\/new-governor-ducey-announces-major-new-investments-rural-broadband\"><span data-contrast=\"none\">broadband conduit<\/span><\/a><span data-contrast=\"auto\">\u00a0in new transportation projects. Some states have developed grant programs to\u00a0<\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=\"><span data-contrast=\"none\">increase public broadband\u00a0<\/span><\/a><span data-contrast=\"auto\">networks in communities with low levels of broadband access. Others have developed\u00a0<\/span><a href=\"https:\/\/detroitmi.gov\/node\/20466\"><span data-contrast=\"none\">hotspot lending programs<\/span><\/a><span data-contrast=\"auto\">\u00a0with libraries and increased bandwidth and connection speeds for\u00a0<\/span><a href=\"https:\/\/dakotacarrier.com\/dcn-delivers-one-gigabit-internet-access-to-north-dakota-k-12-schools\/\"><span data-contrast=\"none\">schools<\/span><\/a><span data-contrast=\"auto\">\u00a0to allow more students to connect at once. Some municipalities and tribes have even created a\u00a0<\/span><a href=\"https:\/\/www.newamerica.org\/oti\/reports\/community-broadband\/\"><span data-contrast=\"none\">public ISP<\/span><\/a><span data-contrast=\"auto\">\u00a0that generally provides higher quality broadband access at lower prices.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">Federal Broadband Intervention<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Many\u00a0<\/span><a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLScQAy8P3Ay3xa-gQQX-nnCEC6pEcwJlXhXqBIZnxtvyDdr-2g\/viewform?fbzx=-7503740540505548422\"><span data-contrast=\"none\">education advocates<\/span><\/a><span data-contrast=\"auto\">\u00a0are asking Congress and the Federal Communication Commission (\u201cFCC\u201d) to help solve the issue. The FCC is in charge of the\u00a0<\/span><a href=\"https:\/\/www.fcc.gov\/consumers\/guides\/universal-service-program-schools-and-libraries-e-rate\"><span data-contrast=\"none\">E-Rate program<\/span><\/a><span data-contrast=\"auto\">\u00a0which allocates money to schools and libraries for telecommunication connections. This\u00a0<\/span><a href=\"https:\/\/www.newamerica.org\/oti\/blog\/homework-gap-leaves-students-further-behind-during-public-health-crisis-policymakers-should-act-immediately\/\"><span data-contrast=\"none\">program<\/span><\/a><span data-contrast=\"auto\">\u00a0would be an ideal way to fund at-home internet connections for students, but the Chairman of the FCC argues that the law, as written,\u00a0<\/span><a href=\"https:\/\/news.bloomberglaw.com\/tech-and-telecom-law\/lawmakers-call-for-billions-to-bridge-homework-gap-in-covid-19\"><span data-contrast=\"none\">does not permit<\/span><\/a><span data-contrast=\"auto\">\u00a0that use.\u00a0<\/span><span data-contrast=\"auto\">It is estimated that the E-Rate program had the authority to allocate $1.5 billion dollars before its fiscal year ended in June but lacked the statutory authority to provide funds to expand off-campus connections.\u00a0<\/span><span data-contrast=\"auto\">The funding was available, but the agency did not ask Congress for the additional authority to put the dollars to the highest and best use. The FCC had conducted a\u00a0<\/span><a href=\"https:\/\/www.gao.gov\/assets\/710\/700629.pdf\"><span data-contrast=\"none\">pilot program<\/span><\/a><span data-contrast=\"auto\"> in 2011 and 2012 to determine if off-premises access should be eligible for the program, but the program did not produce any reported results. The Chairman has also said that he would instead support <\/span><a href=\"https:\/\/news.bloomberglaw.com\/tech-and-telecom-law\/lawmakers-call-for-billions-to-bridge-homework-gap-in-covid-19\"><span data-contrast=\"none\">parallel legislation<\/span><\/a><span data-contrast=\"auto\">\u00a0that is solely focused on distance-learning connectivity.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The FCC does provide funding through the\u00a0<\/span><a href=\"https:\/\/www.wired.com\/story\/school-online-digital-divide-grows-greater\/\"><span data-contrast=\"none\">Rural Digital Opportunity Fund,<\/span><\/a><span data-contrast=\"auto\">\u00a0which is set to spend over $20 billion over the next ten years to expand rural broadband access. This allocation will help, but the<\/span><a href=\"https:\/\/www.fiberbroadband.org\/blog\/new-study-finds-all-fiber-deployments-to-90-of-households-achievable-in-next-decade\"><span data-contrast=\"none\">\u00a0Fiber Broadband Association<\/span><\/a><span data-contrast=\"auto\">\u00a0claims that a plan to get fiber-optic networks to 90 percent of U.S. households will cost an additional $70 billion. The FCC has also helped through the school closures by clarifying that\u00a0<\/span><a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DA-20-324A1.pdf\"><span data-contrast=\"none\">schools and libraries<\/span><\/a><span data-contrast=\"auto\">\u00a0could provide their Wi-Fi signals for the community although their facilities were closed. They have also secured promises from broadband providers\u00a0<\/span><a href=\"https:\/\/www.fcc.gov\/keep-americans-connected\"><span data-contrast=\"none\">not to terminate service<\/span><\/a><span data-contrast=\"auto\">\u00a0for non-payment during the crisis.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Some\u00a0<\/span><a href=\"https:\/\/www.majoritywhip.gov\/?press=clyburn-pallone-and-10-house-dems-announce-plan-to-connect-all-americans-to-affordable-broadband-internet\"><span data-contrast=\"none\">members of Congress\u00a0<\/span><\/a><span data-contrast=\"auto\">are also working to expand broadband access through legislation. One Democratic bill in the House of Representatives would appropriate $4 billion to create an \u201c<\/span><a href=\"https:\/\/www.bloomberglaw.com\/product\/blaw\/document\/X8O44BV0000000?criteria_id=c1b9d87ae860fbf3ac69cdf27045c71a&amp;searchGuid=83e573e8-cac5-4515-a07c-0770cebc9dc1&amp;bna_news_filter=tech-and-telecom-law\"><span data-contrast=\"none\">Emergency Broadband Connectivity Fund<\/span><\/a><span data-contrast=\"auto\">\u201d to subsidize internet access and increase aid for Wi-Fi hotspots. Another House bill focuses primarily on\u00a0<\/span><a href=\"https:\/\/thehill.com\/policy\/technology\/493955-house-democrat-introduces-bill-to-ensure-students-have-internet-access-amid\"><span data-contrast=\"none\">educational access<\/span><\/a><span data-contrast=\"auto\">\u00a0and would create a fund of $2 billion for schools and libraries to buy Wi-Fi hotspots, routers, and internet-connected devices.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<h2><b><span data-contrast=\"auto\">Acknowledging the Issue<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:276}\">\u00a0<\/span><\/h2>\n<p><span data-contrast=\"auto\">Schools made their way through the last quarter of the academic year the best way they could. Some found creative ways to provide access for their students while others relied on antiquated methods of instruction like paper packets. Going forward, schools must continue to determine the limits of the students\u2019 connections and find practical ways to resolve any deficiencies. This may mean that schools will need to work one-on-one with families to resolve a total lack of connection and coach teachers to develop lessons that reduce bandwidth use. While the federal government can certainly help, the responsibility ultimately falls on schools and states to provide a free, appropriate, public education.
