One-by-one, states implemented preventative measures\u00a0<\/span><span data-contrast=\"auto\">via<\/span><span data-contrast=\"auto\">\u00a0temporary school closures<\/span><span data-contrast=\"auto\">\u00a0in efforts to \u201c<\/span><a href=\"https:\/\/www.livescience.com\/coronavirus-flatten-the-curve.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">flatten the curve<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">As of<\/span><span data-contrast=\"auto\">\u00a0mid-May,\u00a0<\/span><span data-contrast=\"auto\">48 states, four United States territories, and the District of Columbia closed schools for the <\/span><a href=\"https:\/\/www.edweek.org\/ew\/section\/multimedia\/map-coronavirus-and-school-closures.html\"><span data-contrast=\"none\">remainder of the academic year<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Remote Learning: Beneficial for All?<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\"><img data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">While e-learning platforms prove useful for a majority of students,\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">remote learning<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span SCXW30884125\">\u00a0students with special needs, and potentially runs\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">contrary to\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">federal\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">disability laws<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">,\u00a0<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">like<\/span><\/span><span class=\"TextRun BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun BCX0 SCXW30884125\">\u00a0the\u00a0<\/span><\/span><a class=\"Hyperlink BCX0 SCXW30884125\" href=\"https:\/\/sites.ed.gov\/idea\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"TextRun Underlined BCX0 SCXW30884125\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"none\"><span class=\"NormalTextRun BCX0 SCXW30884125\" data-ccp-charstyle=\"Hyperlink\">Individuals with Disabilities Education Act (IDEA).<\/span><\/span><\/a><\/p>\n<p><span data-contrast=\"auto\">The\u00a0<\/span><span data-contrast=\"auto\">IDEA\u00a0<\/span><span data-contrast=\"auto\">is a federal law that\u00a0<\/span><span data-contrast=\"auto\">affords eligible children with disabilities access to\u00a0<\/span><a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/edlite-FAPE504.html\"><span data-contrast=\"none\">free appropriate public education (FAPE)<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0In efforts to ensure\u00a0<\/span><span data-contrast=\"auto\">the\u00a0<\/span><span data-contrast=\"auto\">IDEA is enforced during\u00a0<\/span><a href=\"https:\/\/emergency.cdc.gov\/shelterinplace.asp\"><span data-contrast=\"none\">shelter-in-place orders<\/span><\/a><span data-contrast=\"auto\">,\u00a0<\/span><span data-contrast=\"auto\">U.S. Secretary of Education Betsy DeVos published a\u00a0<\/span><a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/frontpage\/faq\/rr\/policyguidance\/Supple%20Fact%20Sheet%203.21.20%20FINAL.pdf\"><span data-contrast=\"none\">supplemental fact sheet<\/span><\/a><span data-contrast=\"auto\">\u00a0on accessibility and distance learning options for children with disabilities. The U.S. Department<\/span><span data-contrast=\"auto\">\u00a0of Education<\/span><span data-contrast=\"auto\">\u00a0emphasized that\u00a0<\/span><span data-contrast=\"auto\">ensuring compliance with\u00a0<\/span><span data-contrast=\"auto\">the\u00a0<\/span><span data-contrast=\"auto\">IDEA \u201cshould not prevent any school from offering education programs through distance instruction<\/span><span data-contrast=\"auto\">.\u201d<\/span><\/p>\n<p><span data-contrast=\"auto\">The\u00a0<\/span><span data-contrast=\"auto\">Department<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">further stated\u00a0<\/span><span data-contrast=\"auto\">that\u00a0<\/span><a href=\"https:\/\/www.understood.org\/en\/school-learning\/special-services\/ieps\/what-is-an-iep\"><span data-contrast=\"none\">I<\/span><span data-contrast=\"none\">ndividualized Education Program (I<\/span><span data-contrast=\"none\">EP<\/span><span data-contrast=\"none\">)<\/span><\/a><span data-contrast=\"auto\"> teams<\/span><span data-contrast=\"auto\">\u2013who design a student\u2019s unique special education program\u2013<\/span><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">must<\/span><span data-contrast=\"auto\">\u00a0make an individualized determination whether and to what extent compensatory services may be needed when schools resume normal operations.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">\u2018<\/span><\/b><b><span data-contrast=\"auto\">Limited Flexibility<\/span><\/b><b><span data-contrast=\"auto\">\u2019<\/span><\/b><b><span data-contrast=\"auto\">\u00a0<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Educational c<\/span><span data-contrast=\"auto\">ompensatory services<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">are given to students<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">with disabilitie<\/span><span data-contrast=\"auto\">s when<\/span><span data-contrast=\"auto\">\u00a0an educational agency fails to provide\u00a0<\/span><span data-contrast=\"auto\">FAPE<\/span><span data-contrast=\"auto\">\u00a0and IEP goals are missed<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">Examples of compensatory services include academic tutoring and occupational therapy.\u00a0<\/span><span data-contrast=\"auto\">Once re-open, s<\/span><span data-contrast=\"auto\">chools<\/span><span data-contrast=\"auto\">\u00a0will be responsible for providing\u00a0<\/span><span data-contrast=\"auto\">such\u00a0<\/span><span data-contrast=\"auto\">services\u00a0<\/span><span data-contrast=\"auto\">to eligible students.<\/span><span data-contrast=\"auto\">\u00a0Uncertainty clouding\u00a0<\/span><span data-contrast=\"auto\">both\u00a0<\/span><span data-contrast=\"auto\">when<\/span><span data-contrast=\"auto\">\u00a0and\u00a0<\/span><span data-contrast=\"auto\">how schools will \u201c<\/span><a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/frontpage\/faq\/rr\/policyguidance\/Supple%20Fact%20Sheet%203.21.20%20FINAL.pdf\"><span data-contrast=\"none\">resume normal operations<\/span><\/a><span data-contrast=\"auto\">\u201d may complicate\u00a0<\/span><span data-contrast=\"auto\">administering<\/span><span data-contrast=\"auto\">\u00a0compensatory services.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On March 27,\u00a0<\/span><span data-contrast=\"auto\">President Trump signed\u00a0<\/span><span data-contrast=\"auto\">the federal coronavirus stimulus relief package into law<\/span><span data-contrast=\"auto\">\u00a0to\u00a0<\/span><span data-contrast=\"auto\">alleviate<\/span><span data-contrast=\"auto\">\u00a0public health and economic impacts\u00a0<\/span><span data-contrast=\"auto\">from<\/span><span data-contrast=\"auto\">\u00a0COVID-19<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">Among other relief, the package\u00a0<\/span><span data-contrast=\"auto\">gave<\/span><span data-contrast=\"auto\">\u00a0Secretary DeVos\u00a0<\/span><a href=\"https:\/\/blogs.edweek.org\/edweek\/campaign-k-12\/2020\/03\/senate-coronavirus-bill-passes-education-funding.html?r=2004858939&amp;r=2109321903\"><span data-contrast=\"none\">waiver authority<\/span><\/a><span data-contrast=\"auto\">\u00a0from federal mandates to grant schools with \u201climited flexibility.\u201d<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Such \u201cflexibility\u201d\u00a0<\/span><span data-contrast=\"auto\">could<\/span><span data-contrast=\"auto\">\u00a0lead to lax state and district measures for ensuring proper accommodations are made for students with disabilities<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">These measures\u00a0<\/span><span data-contrast=\"auto\">could leave<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">students with<\/span><span data-contrast=\"auto\">\u00a0disabilities<\/span><span data-contrast=\"auto\">\u00a0little opportunit<\/span><span data-contrast=\"auto\">y<\/span><span data-contrast=\"auto\">\u00a0to advocate for their education and ultimately, themselves.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Are IDEA Waivers Necessary?<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cNO ADDITIONAL waivers are necessary under either the IDEA or the Rehabilitation Act.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In a<\/span><span data-contrast=\"auto\">n April 3<\/span><span data-contrast=\"auto\">\u00a0<\/span><a href=\"http:\/\/c-c-d.org\/fichiers\/CCD-Ed-TF-letter-to-ED-on-IDEA-COVID-final-04-03-20.pdf\"><span data-contrast=\"none\">letter<\/span><\/a><span data-contrast=\"auto\">\u00a0submitted to Secretary DeVos, over 70 members of the\u00a0<\/span><a href=\"http:\/\/www.c-c-d.org\/rubriques.php?rub=taskforce.php&amp;id_task=2\"><span data-contrast=\"none\">Consortium for Citizens with Disabilities (CCD) Education Taskforce<\/span><\/a><span data-contrast=\"auto\">\u00a0and allies\u00a0<\/span><span data-contrast=\"auto\">affirmed<\/span><span data-contrast=\"auto\">\u00a0their conviction against\u00a0<\/span><span data-contrast=\"auto\">implementing IDEA waivers<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">The advocates\u00a0<\/span><span data-contrast=\"auto\">believed\u00a0<\/span><span data-contrast=\"auto\">because<\/span><span data-contrast=\"auto\">\u00a0the<\/span><span data-contrast=\"auto\">\u00a0IDEA already offers flexibility\u00a0<\/span><span data-contrast=\"auto\">for\u00a0<\/span><span data-contrast=\"auto\">solutions\u00a0<\/span><span data-contrast=\"auto\">to<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">remote<\/span><span data-contrast=\"auto\"> learning, civil rights protections for students with disabilities should not be sacrificed.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The disability advocates<\/span><span data-contrast=\"auto\">\u00a0push<\/span><span data-contrast=\"auto\">ed<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">for\u00a0<\/span><span data-contrast=\"auto\">the Department of Education to enforce four principles that Congress must uphold:\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(1) Local educational agencies must\u00a0<\/span><span data-contrast=\"auto\">continue providing FAPE<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(2)\u00a0<\/span><span data-contrast=\"auto\">Parents must be involved in IEP decisions<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(3) Parents\u00a0<\/span><span data-contrast=\"auto\">retain\u00a0<\/span><span data-contrast=\"auto\">due process rights<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">(4)\u00a0<\/span><span data-contrast=\"auto\">Federal\u00a0<\/span><span data-contrast=\"auto\">education fund<\/span><span data-contrast=\"auto\">\u00a0use\u00a0<\/span><span data-contrast=\"auto\">must adhere to\u00a0<\/span><span data-contrast=\"auto\">the\u00a0<\/span><span data-contrast=\"auto\">IDEA and other civil rights laws<\/span><span data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Practical Applications\u00a0<\/span><\/b><b><span data-contrast=\"auto\">in Lieu of IDEA\u00a0<\/span><\/b><b><span data-contrast=\"auto\">Waivers<\/span><\/b><b><span data-contrast=\"auto\">\u00a0<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">How\u00a0<\/span><span data-contrast=\"auto\">then\u00a0<\/span><span data-contrast=\"auto\">can the Department of Education practically enforce these principles?\u00a0<\/span><span data-contrast=\"auto\">The letter\u00a0<\/span><span data-contrast=\"auto\">suggest<\/span><span data-contrast=\"auto\">ed<\/span><span data-contrast=\"auto\">\u00a0that FAPE under current circumstance<\/span><span data-contrast=\"auto\">s may indicate virtual one-on-one instruction. It may also mean providing students with materials\u00a0<\/span><span data-contrast=\"auto\">containing<\/span><span data-contrast=\"auto\">\u00a0language-specific instructions for families.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Shelter-in-place orders should\u00a0<\/span><span data-contrast=\"auto\">also\u00a0<\/span><span data-contrast=\"auto\">not hinder parent participation.<\/span><span data-contrast=\"auto\">\u00a0CCD state<\/span><span data-contrast=\"auto\">d<\/span><span data-contrast=\"auto\">\u00a0that remote communication between parents and teachers ha<\/span><span data-contrast=\"auto\">d<\/span><span data-contrast=\"auto\">\u00a0already<\/span><span data-contrast=\"auto\">\u00a0been<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">occurring prior to shelter-in-place orders<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">Therefore<\/span><span data-contrast=\"auto\">, virtual communication is practical and\u00a0<\/span><span data-contrast=\"auto\">should be even more encoura<\/span><span data-contrast=\"auto\">ged<\/span><span data-contrast=\"auto\">\u00a0today<\/span><span data-contrast=\"auto\">. CCD further emphasize<\/span><span data-contrast=\"auto\">d<\/span><span data-contrast=\"auto\">\u00a0parents\u2019 vital role in the decision-making process of their child\u2019s education.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Parents\u2019 due process rights can remain intact\u00a0<\/span><span data-contrast=\"auto\">through<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">frequent collaboration<\/span><span data-contrast=\"auto\">\u00a0and communication<\/span><span data-contrast=\"auto\">\u00a0between parents and schools. CTU\u00a0<\/span><span data-contrast=\"auto\">contended the defendants\u2019 handling of special education during the pandemic was inadequate.\u00a0<\/span><span data-contrast=\"auto\">In response to Secret<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">ry DeVos\u2019 recommendations, the<\/span><span data-contrast=\"auto\">\u00a0Chicago Board of Education<\/span><span data-contrast=\"auto\">\u00a0issued a directive that would require a \u201cwhole scale redrafting\u201d of\u00a0<\/span><span data-contrast=\"auto\">roughly 60,000 IEP and Section 504 plan<\/span><span data-contrast=\"auto\">s.\u00a0<\/span><span data-contrast=\"auto\">CTU\u00a0<\/span><span data-contrast=\"auto\">asserted the directive\u00a0<\/span><span data-contrast=\"auto\">would place<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u201can impossible burden to carry out in the roughly six weeks left in the school year.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:282}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On June 19,\u00a0a federal judge\u00a0<\/span><a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/illinois\/ilndce\/1:2020cv02958\/376107\/28\/\"><span data-contrast=\"none\">denied CTU\u2019s request<\/span><\/a><span data-contrast=\"auto\">\u00a0for a preliminary injunction.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">While\u00a0<\/span><span data-contrast=\"auto\">denying injunctive relief, the court commended teachers for their work in trying circumstances: \u201cAlong with the parents and guardians of their young charges, these public servants are the boots on the ground, so to speak, in the effort to ensure that our more vulnerable students continue to receive the education to which they are entitled.
