From the <\/span><a href=\"https:\/\/sabr.org\/journal\/article\/the-black-sox-scandal\/\"><span data-contrast=\"none\">1919 Black Sox<\/span><\/a><span data-contrast=\"auto\"> to the <\/span><a href=\"https:\/\/www.espn.com\/espn\/chalk\/story\/_\/id\/11633538\/betting-chronicling-worst-fix-ever-1978-79-bc-point-shaving-scandal\"><span data-contrast=\"none\">Boston College basketball<\/span><\/a><span data-contrast=\"auto\"> point-shaving debacle to the recent news involving former college quarterback <\/span><a href=\"https:\/\/hls.harvard.edu\/today\/sports-law-expert-examines-the-legal-fallout-of-the-brendan-sorsby-sports-betting-controversy\/\"><span data-contrast=\"none\">Brendan Sorsby<\/span><\/a><span data-contrast=\"auto\">, the negative aspects of mixing sports and gambling seems to far outweigh the positives. In an age where seemingly every sporting event <\/span><a href=\"https:\/\/www.nbcnews.com\/sports\/sports-gambling\/poll-americans-fear-sports-betting-threatening-integrity-games-rcna248940\"><span data-contrast=\"none\">might be rigged<\/span><\/a><span data-contrast=\"auto\">, these public scandals do very little to absolve an industry already facing an integrity crisis.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Just recently, the National Basketball Association (NBA) faced a scandal involving <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/cvgmpp3x5x5o\"><span data-contrast=\"none\">Terry Rozier<\/span><\/a><span data-contrast=\"auto\">, a former NBA player alleged to have removed himself from games and intentionally underperformed in exchange for cash bribes from the mafia and other bettors. Working separately, <\/span><a href=\"https:\/\/www.pbs.org\/newshour\/nation\/read-the-sports-betting-indictment-against-nba-player-terry-rozier-and-others\"><span data-contrast=\"none\">they<\/span><\/a><span data-contrast=\"auto\"> supposedly placed large wagers on Rozier\u2019s underperformance, allowing them to earn a substantial profit. Additionally, Major League Baseball (MLB) faced its own betting scandal when <\/span><a href=\"https:\/\/www.espn.com\/mlb\/story\/_\/id\/49980924\/emmanuel-clase-luis-ortiz-trial-rigged-pitches-list-prosecutors\"><span data-contrast=\"none\">Cleveland Guardians pitchers<\/span><\/a><span data-contrast=\"auto\"> Emmanuel Clase and Luis Ortiz were alleged to have given bettors information of the <\/span><a href=\"https:\/\/www.nytimes.com\/athletic\/7554582\/2026\/09\/01\/mlb-clase-ortiz-pitch-rigging-trial-guardians\/\"><span data-contrast=\"none\">type, velocity, and result<\/span><\/a><span data-contrast=\"auto\"> of a pitch in advance.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">However, these scandals have not prevented sports media companies and prediction markets from partnering. In March 2026, MLB and Polymarket agreed to a <\/span><a href=\"https:\/\/www.wsj.com\/finance\/regulation\/major-league-baseball-steps-into-the-prediction-markets-strikes-deal-with-polymarket-d25c4648\"><span data-contrast=\"none\">licensing deal<\/span><\/a><span data-contrast=\"auto\"> that gave the latter exclusive access to the MLB\u2019s data and iconography. This was preceded by a <\/span><a href=\"https:\/\/www.nhl.com\/news\/nhl-announces-landmark-multiyear-partnerships-with-kalshi-polymarket\"><span data-contrast=\"none\">similar agreement<\/span><\/a><span data-contrast=\"auto\"> struck in October 2025 between the National Hockey League (NHL) and two of the most well-established prediction market platforms, Kalshi and the aforementioned Polymarket.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On the flip side, these partnerships have created the need for guardrails, both within the partnership and outside it. For instance, <\/span><a href=\"https:\/\/www.espn.com\/mlb\/story\/_\/id\/48248176\/mlb-reaches-agreements-polymarket-federal-commission\"><span data-contrast=\"none\">MLB explicitly<\/span><\/a><span data-contrast=\"auto\"> made note of its efforts to contain Polymarket\u2019s reach to events that did not pose an integrity risk to the game. This included betting restrictions on <\/span><a href=\"https:\/\/www.cnbc.com\/2026\/03\/19\/mlb-polymarket-prediction-markets.html\"><span data-contrast=\"none\">certain events<\/span><\/a><span data-contrast=\"auto\">, such as individual pitches, manager decisions, and umpire performance, among others.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">On the administrative side, the CFTC sent out an <\/span><a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/9185-26\"><span data-contrast=\"none\">official advisory<\/span><\/a><span data-contrast=\"auto\"> against insider trading in February of this year after two instances of misuse of nonpublic information by traders. The advisory reaffirmed the CFTC\u2019s authority to police illegal trading practices on prediction markets. In one instance, a political candidate <\/span><a href=\"https:\/\/www.wired.com\/story\/kalshi-insider-trading-california-politician-and-youtuber\/\"><span data-contrast=\"none\">bet on his own candidacy<\/span><\/a><span data-contrast=\"auto\">, and in another, an individual bet on the performance of a YouTube channel he had a formal affiliation with. While these events were monitored and acknowledged, the regulatory framework for prediction markets involving sports remains relatively thin.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559739&quot;:240,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">With these risks in mind, the role of the CFTC has become increasingly vital. Currently, because the CFTC treats prediction markets as swaps, they are governed by federal regulations. Largely speaking, so long as prediction markets avoid listing event contracts that go <\/span><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2026-06-12\/pdf\/2026-11854.pdf#page=6\"><span data-contrast=\"none\">against the public interest<\/span><\/a><span data-contrast=\"auto\">, they are still legal. Initially, <\/span><a href=\"https:\/\/x.com\/On3\/status\/2084995397299093958\"><span data-contrast=\"none\">On3\u2019s press release<\/span><\/a><span data-contrast=\"auto\"> announcing the partnership did not include the topics they intended to exclude on Polymarket, specifically, events related to the collegiate transfer portal and high school commitment decisions. Only after widespread criticism did On3 publish an amended <\/span><a href=\"https:\/\/x.com\/On3\/status\/2085198810863616233\"><span data-contrast=\"none\">press release<\/span><\/a><span data-contrast=\"auto\"> that included a discussion of certain events the partnership would not offer. This sequence shows regulatory guardrails can come from public pressure instead of administrative bodies. But, regardless of what On3 claimed, it is easy to envision a world where the public can bet on what schools players transfer or commit to. Certain states are attempting to enact legislation that limits the proliferation of prediction <\/span><a href=\"https:\/\/www.ncsl.org\/financial-services\/prediction-markets-2026-state-legislation\"><span data-contrast=\"none\">markets and their offerings<\/span><\/a><span data-contrast=\"none\">. <\/span><span data-contrast=\"auto\">In late August, the Ninth Circuit Court of Appeals ruled that the sports-related event contracts offered by prediction markets <\/span><a href=\"https:\/\/finance.yahoo.com\/markets\/stocks\/articles\/draftkings-flutter-jump-court-rules-194622553.html\"><span data-contrast=\"none\">were not swaps under federal law<\/span><\/a><span data-contrast=\"auto\">, opening the door for states to regulate these platforms like they do regular sports betting services.
