In 2026, state legislators introduced <\/span><a href=\"https:\/\/apnews.com\/article\/raw-milk-legislation-outbreak-02c67adf7845d188c41ab0af06e97869\"><span data-contrast=\"none\">more than forty bills<\/span><\/a><span data-contrast=\"auto\"> seeking to expand access to unpasteurized dairy products. Now, federal legislators have entered the conversation with the proposed bipartisan <\/span><a href=\"https:\/\/massie.house.gov\/uploadedfiles\/interstate_milk_freedom_act_of_2026.pdf\"><span data-contrast=\"none\">Interstate Milk Freedom Act<\/span><\/a><span data-contrast=\"auto\"> (Milk Act), which would prevent federal interference with raw milk sales between states that have legalized the product. <\/span><a href=\"https:\/\/www.foodsafetynews.com\/2010\/07\/raw-milk-consumers-dont-turn-us-into-criminals\/#:~:text=The%20agencies%27%20reasons%20for%20doing,right%20to%20freedom%20of%20contract\"><span data-contrast=\"none\">Supporters<\/span><\/a><span data-contrast=\"auto\"> frame these proposals as a matter of personal freedom, claiming that if adults understand the risks, there is no reason for the government to prevent them from drinking milk straight from a farm. That argument, however, assumes that consumers receive enough reliable information about raw milk to fully understand those risks. As a result, raw milk may be sold in retail stores in one state, restricted to on-farm purchases in another, or prohibited entirely elsewhere. However, the differences extend far beyond where raw milk can be purchased. <\/span><a href=\"https:\/\/www.networkforphl.org\/wp-content\/uploads\/2025\/06\/Raw-Milk-Regulation.pdf\"><span data-contrast=\"none\">States also vary considerably<\/span><\/a><span data-contrast=\"auto\"> in raw milk production oversight and required disclosure to consumers. In Illinois, only farms holding a <\/span><a href=\"https:\/\/www.ilga.gov\/ftp\/JCAR\/AdminCode\/077\/077007750000550R.html\"><span data-contrast=\"none\">state raw milk permit<\/span><\/a><span data-contrast=\"auto\"> may sell raw milk, and sales must occur on the farm premises. Illinois also <\/span><a href=\"https:\/\/dph.illinois.gov\/content\/dam\/soi\/en\/web\/idph\/publications\/idph\/topics-and-services\/food-safety\/dairy\/raw-dairy-farm-permit-packet_2023.pdf\"><span data-contrast=\"none\">mandates<\/span><\/a><span data-contrast=\"auto\"> routine sampling, on-site inspections, transaction logs, recall procedures, and a consumer advisory displayed at the point of sale. <\/span><a href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors621.html\"><span data-contrast=\"none\">Oregon<\/span><\/a><span data-contrast=\"auto\">, by contrast, allows farms with no more than two milk-producing cows to sell raw milk directly to consumers on the farm without a dairy license.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Regulation cannot fully eliminate risk<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Even a strict, uniform procedure cannot eliminate the underlying risks of an unpasteurized product. Raw milk can carry <\/span><a href=\"https:\/\/www.fda.gov\/food\/buy-store-serve-safe-food\/food-safety-and-raw-milk\"><span data-contrast=\"none\">pathogens<\/span><\/a><span data-contrast=\"auto\"> including E. coli, Salmonella, Campylobacter, and Listeria. Although Illinois requires routine sampling, the <\/span><a href=\"https:\/\/dph.illinois.gov\/resource-center\/news\/2025\/november\/release-20251107.html\"><span data-contrast=\"none\">Illinois Department of Public Health<\/span><\/a><span data-contrast=\"auto\"> has explained that its testing focuses on temperature, antibiotics, and indicators of contamination, not specific pathogens like E. coli. The limits of this system became clear during a recent Illinois outbreak that resulted in <\/span><a href=\"https:\/\/capitolnewsillinois.com\/news\/raw-milk-proponents-push-for-fewer-restrictions-on-illinois-sales-despite-state-health-warnings\/\"><span data-contrast=\"none\">66 Campylobacter infections<\/span><\/a><span data-contrast=\"auto\">. However, Illinois is not alone. For example, in 2023 and 2024, a <\/span><a href=\"https:\/\/www.cdc.gov\/mmwr\/volumes\/74\/wr\/mm7427a1.htm\"><span data-contrast=\"none\">multistate Salmonella outbreak<\/span><\/a><span data-contrast=\"auto\"> linked to California raw milk produce resulted in 171 identified cases, 70% of which involved children and adolescents.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Informed choice requires more than legality<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">To make consumer choice meaningful, states that legalize raw milk should establish a minimum compliance floor that helps consumers understand the risks and enables regulators to respond effectively to outbreaks. The contrasting state rules show why: legal access alone does not tell consumers which safeguards stand behind a product. <\/span><a href=\"https:\/\/www.networkforphl.org\/wp-content\/uploads\/2025\/06\/Raw-Milk-Regulation.pdf\"><span data-contrast=\"none\">The Network for Public Health Law<\/span><\/a><span data-contrast=\"auto\"> identifies permits, warning labels, periodic testing, and temperature controls as measures that reduce consumer risk. These safeguards should form the foundation of every state framework permitting raw milk sales. Together, they can help detect contamination, inform purchasing decisions, and trace affected products when an outbreak occurs. Warnings are especially important because the risks are not distributed equally amongst individuals. According to the <\/span><a href=\"https:\/\/www.cdc.gov\/food-safety\/foods\/raw-milk.html\"><span data-contrast=\"none\">CDC<\/span><\/a><span data-contrast=\"auto\">, children under five, pregnant people, adults over sixty-five, and people with weakened immune systems face a greater risk of serious illness.
