As of 2026, more than 80% of physicians reported using AI, <\/span><a href=\"https:\/\/www.ama-assn.org\/practice-management\/digital-health\/augmented-intelligence-medicine\"><span data-contrast=\"none\">double<\/span> <span data-contrast=\"none\">the rate reported in 2023<\/span><\/a><span data-contrast=\"auto\">. Physicians reported using health AI for assisting in diagnoses and drafting responses to <\/span><a href=\"https:\/\/www.ama-assn.org\/practice-management\/digital-health\/more-80-physicians-use-ai-professionally-ama-survey\"><span data-contrast=\"none\">patient portal messages<\/span><\/a><span data-contrast=\"auto\">. They believe that AI can be a useful tool for aiding patient convenience, work efficiency, and providing <\/span><a href=\"https:\/\/www.ama-assn.org\/practice-management\/digital-health\/more-80-physicians-use-ai-professionally-ama-survey\"><span data-contrast=\"none\">value based care<\/span><\/a><span data-contrast=\"auto\">. But do patients know that their providers are using AI? To ensure patients are making truly informed decicisons about their health, providers should be required to inform patients when AI is used in their treatment or care.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><!--more--><\/p>\n<p><b><span data-contrast=\"auto\">Who or what is making medical decisions?\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559738&quot;:200,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A Pew Research Center survey revealed that U.S. adults are uncertain if AI is used while being treated by <\/span><a href=\"https:\/\/www.pewresearch.org\/short-reads\/2026\/08\/25\/americans-want-transparency-when-ai-is-used-in-their-healthcare\/\"><span data-contrast=\"none\">healthcare providers<\/span><\/a><span data-contrast=\"auto\">. Despite that, approximately 72% of U.S. adults believe it is important a provider disclose whether or not they are using AI for matters directly affecting their <\/span><a href=\"https:\/\/www.pewresearch.org\/short-reads\/2026\/08\/25\/americans-want-transparency-when-ai-is-used-in-their-healthcare\/\"><span data-contrast=\"none\">medical judgment<\/span><\/a><span data-contrast=\"auto\">. Others believe that AI disclosure should occur even if AI is being used for <\/span><a href=\"https:\/\/www.pewresearch.org\/short-reads\/2026\/08\/25\/americans-want-transparency-when-ai-is-used-in-their-healthcare\/\"><span data-contrast=\"none\">administrative tasks<\/span><\/a><span data-contrast=\"auto\">, such as obtaining prescription refills or scheduling <\/span><span data-contrast=\"none\">appointments<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Informed consent is an essential aspect of ethical healthcare service, which cannot be given unless\u00a0 patients are properly educated about <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/books\/NBK613199\/\"><span data-contrast=\"none\">their care<\/span><\/a><span data-contrast=\"auto\">.\u00a0 Part of that education includes who, or what, is making <\/span><a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC11443239\/\"><span data-contrast=\"none\">medical decisions<\/span><\/a><span data-contrast=\"auto\">. Currently, the legal doctrine of informed consent does not explicitly require the disclosure of AI used to assist in providing <\/span><a href=\"https:\/\/www.law.georgetown.edu\/georgetown-law-journal\/in-print\/volume-108\/volume-108-issue-6-june-2020\/informed-consent-and-medical-artificial-intelligence-what-to-tell-the-patient\/\"><span data-contrast=\"none\">medical care<\/span><\/a><span data-contrast=\"auto\">. However, there may be specific situations or circumstances that require <\/span><a href=\"https:\/\/www.law.georgetown.edu\/georgetown-law-journal\/in-print\/volume-108\/volume-108-issue-6-june-2020\/informed-consent-and-medical-artificial-intelligence-what-to-tell-the-patient\/\"><span data-contrast=\"none\">disclosure<\/span><\/a><span data-contrast=\"auto\">. For example, if AI is used in a way that conflicts with the patient&#8217;s best interest, like the recommendation against a more costly but health <\/span><a href=\"https:\/\/www.law.georgetown.edu\/georgetown-law-journal\/in-print\/volume-108\/volume-108-issue-6-june-2020\/informed-consent-and-medical-artificial-intelligence-what-to-tell-the-patient\/\"><span data-contrast=\"none\">effective treatment option<\/span><\/a><span data-contrast=\"auto\">, then disclosure is required. While patients are informed of AI use in some situations, there is currently no uniform mandate for AI disclosure.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Since there is no uniform federal law that requires healthcare providers to disclose AI use in medical decisions, various state laws have <\/span><a href=\"https:\/\/www.paubox.com\/blog\/which-states-require-disclosure-of-ai-use-in-treatment\"><span data-contrast=\"none\">emerged<\/span><\/a><span data-contrast=\"auto\">. Some states have enacted laws that mandate disclosure of AI use in clinical treatments while others have adopted mandate transparency laws regarding AI use in matters such as patient communication or healthcare administrative <\/span><a href=\"https:\/\/www.paubox.com\/blog\/which-states-require-disclosure-of-ai-use-in-treatment\"><span data-contrast=\"none\">decisions<\/span><\/a><span data-contrast=\"auto\">. For example, California enacted a statute requiring AI disclosure when AI is used to create patient communications as well as instructions on how patients can reach <\/span><a href=\"https:\/\/www.paubox.com\/blog\/which-states-require-disclosure-of-ai-use-in-treatment\"><span data-contrast=\"none\">human healthcare professionals<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Federal regulation of AI use in healthcare does exist\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559738&quot;:200,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Under HTI-1, a federal regulation made by the Office of the National Coordinator for Health Information Technology (ONC), a Department within Health and Human Services (HHS), the ONC has the power to regulate AI transparency, but only between certified health focused IT developers and <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">healthcare providers<\/span><\/a><span data-contrast=\"auto\">. One way ONC regulates AI use in healthcare is by requiring developers of certified health IT to perform risk management for predictive decision support inteverntions (DSIs) within their <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">software<\/span><\/a><span data-contrast=\"auto\">. Predictive DSIs are a healthcare AI tool that use AI to learn from new data and support the decision making process by implementing said data into an <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">algorithm<\/span><\/a><span data-contrast=\"auto\">. Developers are required to disclose how data was acquired and managed, as well as evaluate risks related to <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">accuracy and safety<\/span><\/a><span data-contrast=\"auto\">. ONC also requires that developers of certified health IT disclose risk management practice summaries to a <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">public ONC site<\/span><\/a><span data-contrast=\"auto\">. Thus, some of this information is available to patients who actively look for it.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Additionally, ONC requires certified health IT modules that have predictive DSIs to provide comprehensive information regarding the design, development, and training of <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">predictive DSIs<\/span><\/a><span data-contrast=\"auto\">. Developers are required to disclose whether or not their AI systems have undergone <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">testing and validations<\/span><\/a><span data-contrast=\"auto\">. One of the purposes of this disclosure requirement is to help providers assess whether a predictive DSI meets the ONC \u2018FAVES\u2019 criterion, that is, whether the predictive DSI is <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">fair, appropriate, valid, effective, and safe<\/span><\/a><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Congress should enact federal law mandating provider disclosure of AI use\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559738&quot;:200,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">These examples show that HHS has the ability to enforce disclosure of AI in healthcare. However, these transparency, risk management, and disclosure requirements do not apply to predictive DSIs that have been <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">created internally<\/span><\/a><span data-contrast=\"auto\"> by healthcare providers. They also do not mandate that providers disclose AI use in patient treatment, either for their records or directly to their <\/span><a href=\"https:\/\/bipartisanpolicy.org\/article\/first-into-the-breach-onc-final-rule-addressing-ai-transparency-in-health-care\/\"><span data-contrast=\"none\">patients<\/span><\/a><span data-contrast=\"auto\">. So, although a patient may have access to information on the risk management practices that developers of certified health IT employ, there is still no single federal mandate that requires disclosure of AI use by a provider directly to the patient.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Given the nature of what is at stake in making medical decisions, such as worsening conditions to a patient\u2019s health, providers should be required to disclose AI use to their patients. Informed consent requires providers to ensure that their patients are fully informed about their treatments prior to agreeing with <\/span><a href=\"https:\/\/www.law.cornell.edu\/wex\/informed_consent_doctrine\"><span data-contrast=\"none\">them<\/span><\/a><span data-contrast=\"auto\">. Mandating disclosure of AI use at a federal level ensures a patient\u2019s informed consent is secure, regardless of the state the patient lives or seeks treatment in. A patient cannot be said to have freely made a decision to agree to a particular treatment if they do not have all of the necessary information, such as who, or what, is making these <\/span><a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC11443239\/\"><span data-contrast=\"none\">clinical decisions<\/span><\/a><span data-contrast=\"auto\">.
