BWCs have widely become an essential tool used by law enforcement agencies to enhance accountability, improve transparency, and serve as invaluable tools in legal proceedings. <\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Studies suggest BWCs contribute to a reduction in\u00a0use-of-force incidents. The absence of a federal mandate has led to inconsistent state regulations, which has created compliance challenges and sparked legal debates. This has led to increased compliance challenges and legal debates. There have been several efforts to standardize BWC policies around the country, such as a push by the Department of Justice for a nationwide adoption and H.R. 843, a proposed legislation looking to increase BWC usage. Unfortunately, issues such as financial burdens, officer misuse, and legal barriers continually pose challenges for widespread adoption. Even with all of these obstacles, BWCs have been proven to have a significant impact in the courtroom, helping influence trial strategies and even charging decisions made by attorneys. While BWCs are not the antidote for police misconduct, they are an important step towards communities with greater accountability and justice.<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><!--more--><\/p>\n<p><b><span data-contrast=\"auto\">Discrepancies between federal guidelines &amp; state mandates\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A <\/span><a href=\"https:\/\/www.axon.com\/resources\/police-body-cam\"><span data-contrast=\"none\">study from the National Institute of Justice<\/span><\/a><span data-contrast=\"auto\"> found that in 2017, officers who utilized BWCs \u201cgenerated fewer use-of-force reports and complaints\u201d compared to those officers who did not have a BWC. Specifically, the <\/span><a href=\"https:\/\/urbanlabs.uchicago.edu\/attachments\/84041d261759c2c59d10c1ad062c291f89095586\/store\/6ebe0a908fad49f5efc28f8023ac368ec183922f741eb5e46822ed21c9d6\/CL_BWC+Press+Release.pdf\"><span data-contrast=\"none\">University of Chicago<\/span><\/a><span data-contrast=\"auto\"> published a paper in which researchers found that the use of BWCs can reduce complaints filed against officers by civilians by more than 15%. <\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Given these findings, BWCs have become a crucial tool for holding law enforcement officers accountable. While almost half of state governments have implemented different regulations regarding the use of BWCs, there is no federal mandate. This has caused inconsistencies in the enforcement of BWC usage across the country, leading to compliance challenges and legal debates over their usefulness and privacy concerns.<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The United States Department of Justice (DOJ) is currently pushing for <\/span><a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/justice-department-announces-first-federal-agents-use-body-worn-cameras%22%20\/l%20%22:~:text=On%20June%207%2C%20based%20on,information%20about%20their%20BWC%20program.\"><span data-contrast=\"none\">a nationwide adoption of BWC usage for law enforcement officers<\/span><\/a><span data-contrast=\"auto\">. In June of 2021, the DOJ required law enforcement agencies \u201cto develop policies that require agents to wear and activate BWC recording equipment\u201d during pre-planned arrests and search or seizure warrants and attempts to serve a search warrant. <\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:200,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Congresswoman Eleanor Holmes Norton of DC is currently the sponsor for H.R. 843, the <\/span><a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/843\/all-actions\"><span data-contrast=\"none\">Federal Police Camera and Accountability Act<\/span><\/a><span data-contrast=\"auto\">. The bill would establish a requirement for all federal law enforcement officers to wear BWCs and for cameras to be installed in federal patrol cars. H.R. 843 was introduced in the House of Representatives in February of 2023 and has not made much progress since then. This leaves states up to their own discretion when it comes to the requirements for BWC usage, if they decide to mandate anything at all.<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Furthermore, 24 state governments, plus the District of Columbia, have <\/span><a href=\"https:\/\/kustomsignals.com\/blog\/body-camera-legislation-by-state-all-you-need-to-know-when-implementing-a-program\"><span data-contrast=\"none\">mandates in place requiring the use of BWCs<\/span><\/a><span data-contrast=\"auto\"> for law enforcement officials. For example, 50 ILCS 706\/10-20 in Illinois, known as the <\/span><a href=\"https:\/\/www.ptb.illinois.gov\/media\/1387\/bc-basic-guidelines.pdf\"><span data-contrast=\"none\">Law Enforcement Officer-Worn Body Camera Act<\/span><\/a><span data-contrast=\"auto\">, mandates police officers to wear a BWC and have it turned on \u201cat all times\u201d when the officer is (1) on duty, (2) wearing their uniform or a badge indicating they are a law enforcement officer, and is (3) responding to a call or \u201cengaged in law enforcement-related activity.\u201d This approach is vastly different than Washington state, where cities are merely encouraged to \u201c<\/span><a href=\"https:\/\/www.axon.com\/resources\/body-camera-laws-by-state\"><span data-contrast=\"none\">adopt ordinances or resolutions<\/span><\/a><span data-contrast=\"auto\">\u201d requiring BWC usage. The aforementioned are a few examples of the varying laws across the country regarding BWCs.<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Challenges and concerns regarding the usage of BWCs<\/span><\/b><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">While there is widespread support for the use of BWCs in law enforcement agencies, there are those with serious concerns. Many believe the implementation of BWCs present significant financial, legal, and ethical challenges for law enforcement departments. <\/span><a href=\"https:\/\/www.sj-r.com\/story\/news\/2021\/01\/25\/some-small-illinois-police-departments-swamped-by-body-camera-costs\/6670579002\/\"><span data-contrast=\"none\">BWC costs vary significantly by jurisdiction<\/span><\/a> <span data-contrast=\"auto\">On top of the flat fee for the cameras, there are data storage costs that must be considered. This is just another added burden on agencies who are already struggling financially. Officers may fail to activate their cameras during a stop or <\/span><a href=\"https:\/\/www.cbsnews.com\/chicago\/news\/left-in-the-dark-the-failed-promise-of-chicago-police-body-cameras\/\"><span data-contrast=\"none\">deliberately misuse them<\/span><\/a><span data-contrast=\"auto\"> to avoid capturing illegal or unprofessional activity. Ensuring that officers are trained on the proper usage of BWCs is one of many important aspects of correct implementation. For example, a <\/span><a href=\"https:\/\/www.latimes.com\/california\/story\/2023-09-21\/internal-lapd-reports-show-body-cam-misuse-issue-more-widespread-than-chief-alleges%22%20\/l%20%22:~:text=A%202021%20study%20by%20the%20department's%20inspector,their%20body%20cameras%20in%20a%20timely%20manner.&amp;text=A%20Times%20examination%20of%20department%20reports%20stemming,to%20record%20their%20encounters%20with%20the%20public.\"><span data-contrast=\"none\">study done in Los Angeles in 2021<\/span><\/a><span data-contrast=\"auto\"> revealed that about \u201ca fourth of LAPD officers involved in incidents where serious force was used failed to activate their [BWCs] in a timely manner.\u201d This serious \u2018oversight\u2019 means that massive amounts of pertinent evidence was not captured and cannot be reviewed if a complaint arises.<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">The impact of BWC footage in the courtroom: friend or foe?<\/span><\/b><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Fact: most <\/span><a href=\"https:\/\/pceinc.org\/wp-content\/uploads\/2019\/11\/20180700-Police-Body-Worn-Cameras-The-Prosecutors-Perspective-ABA-Criminal-Justice-Journal-Kristine-Hamann.pdf\"><span data-contrast=\"none\">prosecutors are in favor<\/span><\/a><span data-contrast=\"auto\"> of the use of BWCs. The adoption of BWCs has influenced all aspects of the criminal justice system \u2013 from <\/span><a href=\"https:\/\/www.politico.com\/sponsored\/2024\/06\/body-worn-cameras-build-transparency-and-trust-for-law-enforcement-across-the-nation\/\"><span data-contrast=\"none\">investigations all the way to trial<\/span><\/a><span data-contrast=\"auto\">. These videos can be used to promote transparency and hold those who are in the wrong accountable for their actions, regardless of what side they are on. BWCs have the ability to affect charges being brought forth and strategies utilized by attorneys at trial.\u00a0<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In Chicago, since 2017, the number of BWC videos that have been used by prosecutors has seen an uptick. This footage can help enhance the chance of a satisfactory outcome for prosecutors. Studies indict BWC footage has \u201c<\/span><a href=\"https:\/\/www.axon.com\/resources\/police-body-cam\"><span data-contrast=\"none\">contributed to more arrests and a higher number of guilty pleas<\/span><\/a><span data-contrast=\"auto\">&#8230;\u201d\u00a0In addition to being great evidence to prove a crime, BWC video can also be used to prove the absence of one. A <\/span><a href=\"https:\/\/www.axon.com\/resources\/police-body-cam\"><span data-contrast=\"none\">Texas officer was accused of sexual assault<\/span><\/a><span data-contrast=\"auto\"> by a woman he pulled over. The woman claimed the officer told her she would not face charges if she performed sexual acts with him. This story was later disproved through a review of his BWC footage. No evidence of a crime was found, and the accusation was dropped.\u00a0<\/span><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Conclusion<\/span><\/b><span data-ccp-props=\"{&quot;335559739&quot;:200}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">While BWCs have unmeasured potential to increase police accountability, there are major compliance issues that must be solved. In the future, agencies should be required to focus on blanket mandates for usage to ensure this technology is effectively used. Standardized requirements should outline explicit rules on when officers are required to activate their cameras, explain the penalties for failure to comply or officer misuse, and ensure secure protocols for data storage.
