Upon his entry into office, President Trump solidified this stance by signing an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/strengthening-american-leadership-in-digital-financial-technology\/\">executive order<\/a>: &#8220;Strengthening American Leadership in Digital Financial Technology.\u201d This executive order lightens the regulations on crypto currencies and promotes the presence of crypto in the American economy. Some industry leaders, however, are hesitant about the President\u2019s actions.<\/p>\n<p><!--more--><\/p>\n<p><strong>Trump\u2019s views pre-presidency <\/strong><\/p>\n<p>At the Bitcoin 2024 Conference in Nashville, then-nominee Trump promised to increase electricity production in the United States so it could catch up to other countries in terms of mining bitcoin. Additionally, he made promises to shut down Operation Chokepoint 2.0, the alleged effort by the United States government to staunch banks\u2019 cooperation with cryptocurrency.\u00a0 While this operation is not an official, publicly declared program, <a href=\"https:\/\/www.bankingdive.com\/news\/fdic-letters-cryptos-operation-chokepoint-2-0-claims-coinbase\/735309\/\">letters from the Federal Deposit Insurance Corp<\/a>. (FDIC) that asked a bank to pause crypto-related activity pointed to a government effort to restrict cryptocurrency. Then-nominee Trump also <a href=\"https:\/\/cointelegraph.com\/news\/donald-trump-promises-crypto-bitcoin-election\">promised<\/a> to create a Bitcoin and crypto \u201cpresidential advisory council\u201d and particularly stated that federal agencies should \u201ccease and desist\u201d their actions against crypto.<\/p>\n<p><strong>Post-inauguration actions<\/strong><\/p>\n<p>Three days after his inauguration on January 23<sup>rd<\/sup>, 2025, President Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/strengthening-american-leadership-in-digital-financial-technology\/\">executive order<\/a> (EO) called Strengthening American Leadership in Digital Financial Technology. This EO called for allowing individuals and private entities to access and use open public blockchain networks for lawful purposes without undue interference, encouraging the development of lawful dollar-backed \u201cstablecoins\u201d, strengthening the position of the United States dollar in the global digital economy, and lastly ensuring fair and open access to banking services for all law-abiding citizens and entities. Additionally, the EO established a working group called the President\u2019s Working Group on Digital Asset Markets, which is to be run by certain government officials or their designees like the Secretary of the Treasury, Attorney General, the Secretary of Commerce, and others.<\/p>\n<p><strong>What the EO means for regulation<\/strong><\/p>\n<p>Overall, this EO is considered a win by crypto companies. The main reason for this is because the proposed regulations arising from the working group are not geared towards enforcement, but <a href=\"https:\/\/www.cnbc.com\/2025\/01\/25\/trump-crypto-policy-announcements-spur-industry-optimism.html\">rather towards organizing cryptocurrency<\/a> and helping it make sense. Crypto industry leaders are also optimistic about establishing a <a href=\"https:\/\/www.usatoday.com\/story\/money\/2025\/01\/24\/trump-crypto-task-force-stockpile\/77917823007\/\">national crypto stockpile<\/a>, looking to the working group to create some kind of criteria for a stockpile.<\/p>\n<p>Additionally, the Trump administration <a href=\"https:\/\/qz.com\/trump-cryptocurrency-crypto-executive-order-1851746899\">rolled back<\/a> an EO from the Biden administration that encouraged development of a central back digital currency, a win for the crypto industry. Crypto leaders are excited for the chance that crypto will be <a href=\"https:\/\/www.usatoday.com\/story\/money\/2025\/01\/24\/trump-crypto-task-force-stockpile\/77917823007\/\">pushed into the mainstream<\/a> by Trump\u2019s new regulatory goals. The Securities and Exchange Commission (SEC) is also bolstered by the Trump admin\u2019s EO. On January 23<sup>rd<\/sup>, the same day that Trump\u2019s EO was signed, the SEC revoked Staff Accounting Bulletin 121, which <a href=\"https:\/\/www.crowe.com\/insights\/take-into-account\/sec-rescinds-sab-121-on-crypto-safeguarding-obligation\">required entities<\/a> to record crypto assets as a liability. This bulletin was touted as an <a href=\"https:\/\/www.msn.com\/en-us\/money\/companies\/sec-officially-rescinds-anti-crypto-sab-121\/ar-AA1xKWQm\">anti-crypto measure<\/a>, since it \u201ctied crypto companies in regulatory knots\u201d, and represented the Biden administration\u2019s regulatory approach to crypto. The new SEC has also launched a crypto task force led by Commissioner Hester Pierce, who is seen as pro-crypto because she <a href=\"https:\/\/qz.com\/trump-cryptocurrency-crypto-executive-order-1851746899\">dissented<\/a> when the SEC rejected a bitcoin exchange-traded fund. This task force seeks to \u201c foster a regulatory environment that protects investors, facilitates capital formation, fosters market integrity, and supports innovation,\u201d which points to an SEC that will employ an <a href=\"https:\/\/qz.com\/trump-sec-crypto-task-force-bitcoin-regulations-atkins-1851743999?_gl=1*1i7pezg*_ga*MTY1NjQyMDgwNC4xNzIxMDcwOTUy*_ga_V4QNJTT5L0*MTczNzcyMjA1MC40ODcuMS4xNzM3NzI0Njk0LjYwLjAuMA..\">open approach crypto<\/a>, rather than former commissioner Gensler\u2019s enforcement actions. Despite these actions and the crypto industry\u2019s optimism, Trump\u2019s lack of understanding of crypto may disadvantage the industry.<\/p>\n<p><strong>$TRUMP<\/strong><\/p>\n<p>Right before his inauguration, Trump announced his own crypto coin, $TRUMP. To some, this signaled an all-encompassing embrace of the crypto industry. To others, however, it showed Trump\u2019s lack of true support for the industry. $TRUMP is considered a \u201cmeme coin\u201d which is a form of crypto that is <a href=\"https:\/\/www.washingtonpost.com\/technology\/2025\/01\/25\/trump-coin-crypto-melania\/\">more volatile<\/a>, given that it is not tied to any kind of value, merely some kind of keepsake for a fan. The existence of meme coins represent the \u201cscammier\u201d part of the industry and, according to an <a href=\"https:\/\/www.washingtonpost.com\/technology\/2025\/01\/25\/trump-coin-crypto-melania\/\">industry leader<\/a>, a \u201cperfect bribery vehicle\u201d.<\/p>\n<p><strong>Will the industry\u2019s hope last?<\/strong><\/p>\n<p>Cryptocurrency is already a volatile industry, with <a href=\"https:\/\/freemanlaw.com\/legal-issues-surrounding-cryptocurrency\/\">controversy after controversy<\/a>. The industry is in desperate need of regulations. Even President Trump\u2019s administration putting positive regulations in place in opposition to enforcement actions would be preferable to the situation at hand: a president with little understanding of the industry he is embracing with open arms.
