The EPA announced the final \u201c<\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">Good Neighbor Plan<\/span><\/a><span style=\"font-weight: 400;\">\u201d on March 15, 2023. The \u201c<\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">Good Neighbor Plan<\/span><\/a><span style=\"font-weight: 400;\">\u201d established under the Clean Air Act (CAA) aims at reducing emissions from upwind states that cause pollution in downwind states.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In response to the EPA finalizing the rule, three states \u23af Ohio, Indiana, and West Virginia \u23af <\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/284940\/20231013090543221_SCOTUS%20Stay%20Application.pdf\"><span style=\"font-weight: 400;\">filed suit in the D.C. Circuit<\/span><\/a><span style=\"font-weight: 400;\"> claiming a violation of the Administrative Procedure Act. After the D.C. Circuit refused to stay the administrative action, the three aforementioned states filed an \u201c<\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/284940\/20231013090543221_SCOTUS%20Stay%20Application.pdf\"><span style=\"font-weight: 400;\">Emergency Application for Stay of Administrative Action<\/span><\/a><span style=\"font-weight: 400;\">\u201d with the U.S. Supreme Court. The <\/span><a href=\"https:\/\/apnews.com\/article\/supreme-court-epa-good-neighbor-air-pollution-rules-9d29c120d276f4bad5b3ea2c75d107ff\"><span style=\"font-weight: 400;\">Supreme Court heard oral arguments<\/span><\/a><span style=\"font-weight: 400;\"> on a temporary stay for the \u201cGood Neighbor\u201d regulation on February 21, 2024, and the EPA awaits the resulting ruling.\u00a0<\/span><\/p>\n<p><!--more--><\/p>\n<p><b>What is the \u201cGood Neighbor\u201d plan and why is it controversial?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The EPA <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">finalized the \u201cGood Neighbor\u201d plan <\/span><\/a><span style=\"font-weight: 400;\">to complete their obligation under the CAA to address pollution caused by nitrogen oxide emissions traveling beyond state boundaries. <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">Traveling air pollution<\/span><\/a><span style=\"font-weight: 400;\"> can contribute to unhealthy levels of ozone pollution, forming smog and leading to health impacts such as respiratory problems, asthma, and other lung-related illness.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">rule<\/span><\/a><span style=\"font-weight: 400;\">, originally created in 2015, mainly applied to states located in the Midwest and South who produced ozone pollution that spread to other localities along the East Coast. Some states included in the <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">\u201cGood Neighbor\u201d plan<\/span><\/a><span style=\"font-weight: 400;\">, like Illinois, both cause downwind pollution and face effects from other state\u2019s pollution.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EPA estimates that the final rule implementing the \u201cGood Neighbor\u201d plan would result in <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">numerous public health benefits<\/span><\/a><span style=\"font-weight: 400;\">: reduction of asthma cases by at least 1.3 million, prevention of approximately 1,300 premature deaths, and an abatement of approximately 2,300 hospital or emergency room visits.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-final-good-neighbor-plan-cut-harmful-smog-protecting-health-millions\"><span style=\"font-weight: 400;\">\u201cGood Neighbor\u201d plan<\/span><\/a><span style=\"font-weight: 400;\"> has faced pressure from each side of the political spectrum. During <\/span><a href=\"https:\/\/apnews.com\/epa-plan-would-limit-downwind-pollution-from-power-plants-b319d86b609aa149f58d4895be406bb2\"><span style=\"font-weight: 400;\">the Obama era<\/span><\/a><span style=\"font-weight: 400;\">, republicans and business leaders claimed that the plan may harm the economy and could cause a loss of jobs. The <\/span><a href=\"https:\/\/apnews.com\/epa-plan-would-limit-downwind-pollution-from-power-plants-b319d86b609aa149f58d4895be406bb2\"><span style=\"font-weight: 400;\">Trump Administration<\/span><\/a><span style=\"font-weight: 400;\"> worked to weaken the rule. However, <\/span><a href=\"https:\/\/apnews.com\/epa-plan-would-limit-downwind-pollution-from-power-plants-b319d86b609aa149f58d4895be406bb2\"><span style=\"font-weight: 400;\">the EPA under the Biden administration<\/span><\/a><span style=\"font-weight: 400;\"> has worked to restore control over air pollution caused by both power plants and industrial sites.\u00a0<\/span><\/p>\n<p><b>What led to the current litigation over the \u201cGood Neighbor\u201d plan and how will the Supreme Court ruling impact the EPA\u2019s actions?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The EPA ordered states to <\/span><a href=\"https:\/\/www.ncsl.org\/state-legislatures-news\/details\/supreme-court-hears-challenge-to-the-epas-good-neighbor-plan#:~:text=The%20justices%20will%20consider%20whether,the%20ozone%2Dreduction%20rule's%20reasonableness.&amp;text=The%20EPA's%20%E2%80%9Cgood%20neighbor%E2%80%9D%20rule,industrial%20facilities%20in%2023%20states.\"><span style=\"font-weight: 400;\">create plans<\/span><\/a><span style=\"font-weight: 400;\"> aimed at reducing the impact of downwind air pollution. However, <\/span><a href=\"https:\/\/www.ncsl.org\/state-legislatures-news\/details\/supreme-court-hears-challenge-to-the-epas-good-neighbor-plan#:~:text=The%20justices%20will%20consider%20whether,the%20ozone%2Dreduction%20rule's%20reasonableness.&amp;text=The%20EPA's%20%E2%80%9Cgood%20neighbor%E2%80%9D%20rule,industrial%20facilities%20in%2023%20states.\"><span style=\"font-weight: 400;\">twenty-one states<\/span><\/a><span style=\"font-weight: 400;\"> submitted plans to the EPA that included no reduction or changes to their emissions. The <\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/284940\/20231013090543221_SCOTUS%20Stay%20Application.pdf\"><span style=\"font-weight: 400;\">EPA rejected the plans<\/span><\/a><span style=\"font-weight: 400;\"> in early 2022, announcing a plan to create a federally-coordinated nationwide plan to reduce emissions instead for twenty-three states.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The states of Ohio, Indiana, and West Virginia <\/span><a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A349\/284940\/20231013090543221_SCOTUS%20Stay%20Application.pdf\"><span style=\"font-weight: 400;\">filed suit<\/span><\/a><span style=\"font-weight: 400;\"> under the Administrative Procedure Act, which sets forth rulemaking procedures, covers agency action, and sets standards for judicial review for cases where a party is aggrieved by agency action. The <\/span><a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-administrative-procedure-act#:~:text=(1946),on%20notices%20of%20proposed%20rulemaking.\"><span style=\"font-weight: 400;\">Administrative Procedure Act<\/span><\/a><span style=\"font-weight: 400;\"> requires agencies to make decisions in a way that is not arbitrary or capricious, meaning the decisions made on a whim or without regard to facts or law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court\u2019s ruling will temporarily block the \u201cGood Neighbor\u201d plan from taking effect, however, it may lead to a \u201ctrickle down\u201d effect where litigation across the country begins increasing as states aim to prevent the EPA from implementing the federal plan. While the states cite the <\/span><a href=\"https:\/\/www.ncsl.org\/state-legislatures-news\/details\/supreme-court-hears-challenge-to-the-epas-good-neighbor-plan#:~:text=The%20justices%20will%20consider%20whether,the%20ozone%2Dreduction%20rule's%20reasonableness.&amp;text=The%20EPA's%20%E2%80%9Cgood%20neighbor%E2%80%9D%20rule,industrial%20facilities%20in%2023%20states.\"><span style=\"font-weight: 400;\">unreasonable costs of compliance<\/span><\/a><span style=\"font-weight: 400;\"> as a reason for the emergency stay, the EPA claims that <\/span><a href=\"https:\/\/www.ncsl.org\/state-legislatures-news\/details\/supreme-court-hears-challenge-to-the-epas-good-neighbor-plan#:~:text=The%20justices%20will%20consider%20whether,the%20ozone%2Dreduction%20rule's%20reasonableness.&amp;text=The%20EPA's%20%E2%80%9Cgood%20neighbor%E2%80%9D%20rule,industrial%20facilities%20in%2023%20states.\"><span style=\"font-weight: 400;\">each plan is workable<\/span><\/a><span style=\"font-weight: 400;\"> if the states are willing to comply.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The air quality benefits of the \u201cGood Neighbor\u201d plan far outweigh any costs the state may have to bear in reaching compliance.
