But, these are not merely isolated incidents; they are the very manifestations that climate change experts <a href=\"https:\/\/www.theguardian.com\/environment\/2023\/jul\/19\/climate-crisis-james-hansen-scientist-warning#:~:text=Hansen%2C%20whose%20testimony%20to%20the,years%2C%20bringing%20impacts%20such%20as\">have long warned us about<\/a>. While <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2019\/04\/18\/a-look-at-how-people-around-the-world-view-climate-change\/#:~:text=Majorities%20in%20most%20surveyed%20countries,issue%20the%20survey%20asked%20about.\">global awareness<\/a> of the need for action grows, the United States continues to lag. Notwithstanding the recent unveiling of the <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/09\/20\/fact-sheet-biden-harris-administration-launches-american-climate-corps-to-train-young-people-in-clean-energy-conservation-and-climate-resilience-skills-create-good-paying-jobs-and-tackle-the-clima\/\">American Climate Corps<\/a> by the Biden Administration, environmental policies across the country face resistance from <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/sackett-v-environmental-protection-agency\/\">courts<\/a> and <a href=\"https:\/\/climate.law.columbia.edu\/climate-deregulation-tracker\">legislators<\/a>, leading to the emergence of the \u2018Green Scare\u2019 movement. In this context, an unexpected trend has materialized\u2014the younger generation is fighting back.<\/p>\n<p><!--more--><\/p>\n<p><strong><em>The right to a healthy environment<\/em><\/strong><\/p>\n<p>According to <a href=\"https:\/\/leg.mt.gov\/bills\/mca\/Constitution\/IX\/1.htm#:~:text=Constitution%20of%20Montana%20%2D%2D%20Article,for%20present%20and%20future%20generations.\">Montana\u2019s state constitution<\/a>, its citizens are entitled to a \u201cclean and healthful environment\u201d for the benefit of \u201cpresent and future generations.\u201d While some may view this as mere puffery, a group of kids understood it as an inalienable, inviolable right. Consequently, when legislators passed <a href=\"https:\/\/leg.mt.gov\/bills\/2023\/billpdf\/HB0971.pdf\">provisions of Montana\u2019s State Energy Policy Act<\/a> which prohibited state actors from considering the deleterious environmental impacts of certain fossil fuels in assessments conducted during the implementation of a fossil fuel-based energy system, they quickly found themselves in hot water. In <a href=\"https:\/\/climatecasechart.com\/case\/11091\/\"><em>Held v. Montana<\/em><\/a>, sixteen youths filed suit against the State and its governor, among others, alleging that the fossil fuel-based energy system violated their constitutional right to a healthy environment. A contentious battle ensued, but ultimately, the young plaintiffs <a href=\"https:\/\/www.nytimes.com\/2023\/08\/14\/us\/montana-youth-climate-ruling.html#:~:text=A%20group%20of%20young%20people,fossil%20fuel%20projects%20was%20unconstitutional.\">triumphed<\/a>.<\/p>\n<p>In its <a href=\"https:\/\/climatecasechart.com\/wp-content\/uploads\/case-documents\/2023\/20230814_docket-CDV-2020-307_order.pdf\">analysis<\/a>, the district court focused primarily on the extensive scientific data put forth by the plaintiffs. The court\u2019s order emphasized the discernible consequences of climate change, including \u201chardship to every sector\u201d of the state\u2019s economy, increased annual temperatures, and the decline of available water, among several other grim results. The plaintiffs recognized the limitations of the legal system themselves and, to avoid any challenges to their standing, offered evidence of how the fossil fuel provision <a href=\"https:\/\/climatecasechart.com\/wp-content\/uploads\/case-documents\/2023\/20230705_docket-CDV-2020-307_findings-of-fact-and-conclusions-of-law.pdf\">directly impacted them<\/a>. Their strategy was successful as the district court <a href=\"https:\/\/climatecasechart.com\/wp-content\/uploads\/case-documents\/2023\/20230814_docket-CDV-2020-307_order.pdf\">ruled in their favor<\/a>, noting that the state\u2019s fossil fuel consumption in 2019 resulted in \u201cabout 32 million tons of CO<sub>2<\/sub> being released into the Atmosphere.\u201d<\/p>\n<p>While similar suits in <a href=\"https:\/\/climatecasechart.com\/case\/reynolds-v-florida\/#:~:text=Florida,-Filing%20Date%3A%202018&amp;text=Description%3A%20Action%20by%20eight%20young,law%20and%20the%20Florida%20constitution.\">Florida<\/a>, <a href=\"https:\/\/apnews.com\/article\/richmond-lawsuits-virginia-climate-and-environment-8c9b90ec8dcc33b0419ed6e3fdddd460\">Virginia<\/a>, and <a href=\"https:\/\/climatecasechart.com\/case\/aji-p-v-state-washington\/\">Washington<\/a> were not so successful, young people have not been dismayed. New challenges have cropped up in <a href=\"https:\/\/www.nmlandairwatersacred.org\/\">New Mexico<\/a> and <a href=\"https:\/\/earthjustice.org\/case\/navahine-v-hawaii-department-of-transportation\">Hawai&#8217;i<\/a> and the long-delayed <a href=\"https:\/\/apnews.com\/article\/youth-climate-lawsuit-trial-oregon-7ad2fa18f5276f12c64c0ce775aba2f6\">Juliana v. United States<\/a> has been revived once more. The latter suit involves twenty-one young plaintiffs arguing <a href=\"https:\/\/e360.yale.edu\/digest\/juliana-youth-climate-lawsuit-trial\">that the U.S. government<\/a> has prioritized a fossil fuel-oriented economy to the detriment of the climate and the environment. Originally filed in <a href=\"https:\/\/climatecasechart.com\/case\/juliana-v-united-states\/\">2015<\/a>, the case remained dormant until earlier this year when a federal district court judge permitted the plaintiffs to amend their complaint and progress to trial. Going further, a group of <a href=\"https:\/\/www.bbc.com\/news\/world-europe-66923590?xtor=AL-72-%5Bpartner%5D-%5Bbbc.news.twitter%5D-%5Bheadline%5D-%5Bnews%5D-%5Bbizdev%5D-%5Bisapi%5D&amp;at_ptr_name=twitter&amp;at_link_id=77E5F31E-5CD0-11EE-B101-0272FE754D29&amp;at_link_origin=BBCWorld&amp;at_link_type=web_link&amp;at_bbc_team=editorial&amp;at_campaign=Social_Flow&amp;at_format=link&amp;at_medium=social&amp;at_campaign_type=owned&amp;s=01\">six young people<\/a> from Portugal filed suit against thirty-two countries, including all member states of the European Union, in the European Court of Human Rights in an effort to combat climate change. Indeed, such efforts have prompted the United Nations to <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2023\/08\/urgent-action-states-needed-tackle-climate-change-says-un-committee-guidance\">publish guidance<\/a> on the rights of children to a healthy environment.<\/p>\n<p><strong><em>Curtailing environmental safeguards<\/em><\/strong><\/p>\n<p>Sadly, despite widespread knowledge of the <a href=\"https:\/\/climate.nasa.gov\/effects\/\">dire consequences of climate change<\/a>, the Environmental Protection Agency (EPA) has been forced to make significant rollbacks in its regulations. In particular, the agency was <a href=\"https:\/\/www.epa.gov\/wotus\/amendments-2023-rule\">made to redefine<\/a> its \u201cWaters of the United States\u201d rule, resulting in the removal of wetland and waterway protections across the nation. The change resulted from the Supreme Court\u2019s decision in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-454_4g15.pdf\"><em>Sackett v. Environmental Protection Agency<\/em><\/a> which effectively gutted the EPA\u2019s authority under the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2018-title33\/pdf\/USCODE-2018-title33-chap26.pdf\">Clean Water Act<\/a> (CWA).<\/p>\n<p>In the case, an Idaho couple brought a lawsuit against the EPA after the agency prohibited them from constructing a house near a lake, asserting that the property contained wetlands protected under the CWA. <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-water-act\">The Act<\/a> prohibits pollution of &#8216;navigable waters,&#8217; which encompasses wetlands like those on the Sacketts&#8217; property. In an opinion written by Justice Alito, the Court concluded that the CWA must be understood to define \u2018wetlands\u2019 as being \u201cindistinguishable from waters of the United States\u201d having \u201ca continuous surface connection to bodies that are \u2018waters of the United States\u2019 in their own right.\u201d The opinion prioritized property rights over the need to reduce and eliminate pollution of water sources, as highlighted in <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-water-act\">multiple concurrences<\/a>. The decision is a significant blow to the health and vitality of <a href=\"https:\/\/www.epa.gov\/report-environment\/wetlands\">wetlands and waterways<\/a>, resulting in not only a reduction in water quality, but also the efficacy of such bodies to serve as atmospheric carbon sinks. Even more, the decision will assuredly result in reduced biodiversity given that wetlands, specifically, are some of the most <a href=\"https:\/\/www.nature.com\/scitable\/knowledge\/library\/ecology-of-wetland-ecosystems-water-substrate-and-17059765\/\">biologically diverse ecosystems<\/a> on Earth. The opinion comes just one year after the <a href=\"https:\/\/www.nytimes.com\/2022\/06\/30\/us\/epa-carbon-emissions-scotus.html\">Supreme Court made similar reductions<\/a> in the EPA\u2019s ability to enforce the <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-air-act\">Clean Air Act<\/a>.<\/p>\n<p><strong><em>Hope on the horizon<\/em><\/strong><\/p>\n<p>While the current legal landscape may be disheartening, the perseverance of the <em>Held<\/em> plaintiffs and the rise of other youth-led movements in the United States offers a glimmer of hope. The <a href=\"https:\/\/www.un.org\/climatechange\/climate-ambition-summit\">ongoing UN Climate Ambition Summit<\/a> will, hopefully, result in more significant action on the part of global actors. Additionally, the Biden Administration <a href=\"https:\/\/www.nytimes.com\/2023\/09\/21\/climate\/biden-climate-change-economic-cost.html\">recently issued a directive<\/a> obligating federal agencies to consider the costs of climate change in their budgets. While more <a href=\"https:\/\/www.pbs.org\/newshour\/science\/humanity-can-still-stop-worst-consequences-of-climate-change-but-time-is-running-out-ipcc-warns\">impactful actions<\/a> are needed, these steps are important. In the end, Americans should acknowledge the dedication of the Montana youths and find inspiration in their example to work towards a brighter future for the environment.
