Florida\u2019s governor and current Presidential candidate, Ron Desantis, defines <\/span><a href=\"https:\/\/www.flgov.com\/wp-content\/uploads\/2021\/12\/Stop-Woke-Handout.pdf\"><span data-contrast=\"none\">W.O.K.E<\/span><\/a><span data-contrast=\"auto\"> as \u201cWrongs to Our Kids and Employees\u201d. The passing of this legislation follows another highly controversial piece of legislation passed earlier this year, Florida\u2019s \u201c<\/span><a href=\"https:\/\/www.americanbar.org\/groups\/labor_law\/publications\/labor_employment_law_news\/fall-2022\/florida-do-not-say-gay-law\/\"><span data-contrast=\"none\">Don\u2019t Say Gay<\/span><\/a><span data-contrast=\"auto\">\u201d bill, that largely bars Florida educators from discussing LGBTQIA+ topics with students. Governor Desantis\u00a0 has led an aggressive campaign against academic freedom to combat a perceived \u201cwoke indoctrination in [U.S] schools, that is a road to ruin for this country\u201d. The implementation of this legislation brings up valid concerns regarding the First Amendment rights of the State\u2019s educators and population at large.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><!--more--><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Stop W.O.K.E Act<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Florida\u2019s \u201cStop W.O.K.E\u201d Act <\/span><a href=\"https:\/\/www.flsenate.gov\/Media\/PressReleases\/Show\/4387#:~:text=DeSantis%27%20%E2%80%9CStop%20Woke%20Act%E2%80%9D,%2C%20national%20origin%2C%20or%20sex.\"><span data-contrast=\"none\">essentially prohibits instruction on race relations<\/span><\/a><span data-contrast=\"auto\"> or diversity that imply that a person\u2019s status as either privileged or oppressed is necessarily determined by his or her race, color, national origin, or sex.\u00a0 To comply with the Act, the Florida Board of Governors has required each Florida university implement <\/span><a href=\"https:\/\/plus.lexis.com\/document\/documentlink\/?pdmfid=1530671&amp;crid=1791d756-dd44-4d39-a9a2-56241f6b7195&amp;pddocfullpath=%2Fshared%2Fdocument%2Ffe%2Furn%3AcontentItem%3A68DG-8P03-CGX8-0341-00000-00&amp;pdcontentcomponentid=6258&amp;pdproductcontenttypeid=undefined&amp;pdiskwicview=false&amp;pdpinpoint=_4_a&amp;prid=c7d301f0-20e8-4f94-bda7-07fbd9a26905&amp;ecomp=2gntk\"><span data-contrast=\"none\">investigatory protocols<\/span><\/a><span data-contrast=\"auto\"> that mandate the University to notify the Board if an instructor\u2019s teachings or training violate the Act. If the professor refuses to comply with the new policies, the University has the right to terminate them from their position.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Various courses of study, including Gender Studies, African-American Studies, and more, are at risk due to the implementation of this Act. These concerns are not unfounded, as AP African-American Studies has already been barred from Florida high schools curriculum due to its \u201c<\/span><a href=\"https:\/\/www.reuters.com\/world\/us\/florida-schools-will-not-offer-ap-african-american-studies-course-2023-01-20\/\"><span data-contrast=\"none\">lack of educational value<\/span><\/a><span data-contrast=\"auto\">\u201d.\u00a0 If these disciplines are found to be in violation of the Act and ultimately removed from the higher education curriculum, thousands of educators could be at risk of losing their jobs.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Alleged First Amendment Violations<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Supreme Court has made clear that academic freedom is of special concern to the First Amendment through its bar of laws that cast a \u2018pall of orthodoxy\u2019 over the classroom. Further, <\/span><a href=\"https:\/\/plus.lexis.com\/document\/?pdmfid=1530671&amp;crid=c48045d1-ec3c-427e-b8ea-81b71e6c05d8&amp;pddocfullpath=%2Fshared%2Fdocument%2Fcases%2Furn%3AcontentItem%3A66WF-VYY1-JXG3-X45Y-00000-00&amp;pdcontentcomponentid=6421&amp;pdteaserkey=&amp;pdislpamode=false&amp;pdworkfolderlocatorid=NOT_SAVED_IN_WORKFOLDER&amp;ecomp=n74k&amp;earg=sr1&amp;prid=497dcfc9-3532-4b1f-b519-fa1480d34abc\"><span data-contrast=\"none\">Florida court\u2019s<\/span><\/a><span data-contrast=\"auto\"> have affirmed that the First Amendment protects the right to receive information, which is dependent on the protection of an individual\u2019s right to disseminate that information. The restraints this Act implements directly go against these principles.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Through its vague, but wide-stretching ban of race-related topics, the Act makes it increasingly difficult for individuals to have a complete and honest conversation about American history and their personal experiences. Classrooms are meant to be a marketplace of ideas, with instructors leading the difficult, but necessary conversations that focus on our society. The government has no legitimate interest in preventing this dialogue from occurring.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Harm on BIPOC Communities<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Black and Brown communities, as well as the ACLU, ACLU of Florida, NAACP, and the Legal Defense Fund, understand this law to be as horrifying as it seems.\u00a0 The NAACP has issued a <\/span><a href=\"https:\/\/naacp.org\/articles\/naacp-issues-travel-advisory-florida\"><span data-contrast=\"none\">travel advisory<\/span><\/a><span data-contrast=\"auto\"> for African Americans, people of color, and LGBTQ+ individuals, citing Florida\u2019s recent legislation as a direct attack on communities of color and their lived experiences with racism and discrimination.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This Act bars the already limited funding that public universities allocate towards diversity and inclusion. This harms communities of color, specifically Black Americans, by erasing their history and criminalizing open and honest conversations about their history. However, communities of color are not the only ones harmed by this miseducation. The censorship occurring in Florida is a disservice to every person living in Florida and should be a major concern to Americans at large.\u00a0 Not only is it a disservice, but it is against the core values outlined in our Constitution, specifically in the First Amendment. The First Amendment protects discussions about these topics, leaving no place for politics to decide what discussions are \u201cappropriate\u201d for educational institutions.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Fighting Back<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Schools and universities enjoy the right to limit the speech of their employees as it pertains to their <\/span><a href=\"https:\/\/www.nea.org\/resource-library\/first-amendment-protections-educators\"><span data-contrast=\"none\">official duties<\/span><\/a><span data-contrast=\"auto\">, but these limitations must serve a legitimate purpose. Censorship based solely on the popularity of ideologies cannot stand.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/ncffreedom.org\/\"><span data-contrast=\"none\">NCF Freedom<\/span><\/a><span data-contrast=\"auto\">, a non-profit organization in Florida dedicated to protecting academic freedom and educational innovation, filed a lawsuit against the Florida Board of Governors of the State University System, and the Board of Trustees at New College of Florida. In their lawsuit, NCF Freedom alleges that the Act <\/span><a href=\"https:\/\/ncffreedom.org\/f\/ncf-freedom-files-free-speech-lawsuit-against-state-of-florida\"><span data-contrast=\"none\">violates the First Amendment<\/span><\/a><span data-contrast=\"auto\"> through its censorship of the teaching and discussion of topics that the current administration finds unfavorable.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Similar lawsuits alleging First Amendment violations are likely to be filed against the State and Florida Board of Governors in the coming months. Students and educators should not suffer due to political agendas.
