Cannabis is the <a href=\"https:\/\/informationisbeautiful.net\/visualizations\/what-is-the-worlds-biggest-cash-crop\/\">most lucrative crop<\/a> globally and the cash-making abilities of cannabis have been proven true in Illinois. Sales in the state <a href=\"https:\/\/www.marijuanamoment.net\/illinois-sold-more-than-1-billion-worth-of-legal-marijuana-in-2020-new-state-data-shows\/\">exceeded $1 billion<\/a> in the first full year of legalization, resulting in a <a href=\"https:\/\/www.thecentersquare.com\/illinois\/more-than-205-4-million-in-cannabis-taxes-collected-in-illinois-as-nonprofits-receive-first\/article_dffc112c-67e6-11eb-a04c-8b20556147ac.html\">$205.4 million tax windfall<\/a> for Illinois. This success, however, is no small feat for cannabis companies considering the <a href=\"https:\/\/scholarlycommons.law.case.edu\/cgi\/viewcontent.cgi?article=1043&amp;context=caselrev#:~:text=Although%20marijuana%20is%20illegal%20under,have%20legalized%20some%20marijuana%20use.&amp;text=It%20explains%20that%20although%20the,regulation%20is%20per\">banking<\/a> and <a href=\"https:\/\/www.crcgroup.com\/Portals\/34\/Flyers\/Tools-Intel\/Medical Marijuana Article_2020.pdf?ver=2020-01-22-112859-077\">insurance obstacles<\/a> they must overcome to start this type of business. <a href=\"https:\/\/fas.org\/sgp\/crs\/misc\/R43034.pdf\">Federalism<\/a> is at the heart of many of these hurdles.<\/span><!--more--><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\"><strong>The cannabis supply chain \u2013\u2013 where is insurance needed? <\/strong><\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">The <a href=\"https:\/\/content.naic.org\/sites\/default\/files\/inline-files\/cmte_c_cannabis_wg_exposure_understanding_cannabis_marketplace_0.pdf\">cannabis supply chain includes<\/a> cannabis cultivation, processors\/harvesters, manufacturers, retailer, distributors, testing labs, and microbusinesses. At virtually every level of these businesses, <a href=\"https:\/\/content.naic.org\/sites\/default\/files\/inline-files\/cmte_c_cannabis_wg_exposure_understanding_cannabis_marketplace_0.pdf\">insurance is needed<\/a> \u2013\u2013 from equipment and crop insurance to workers\u2019 compensation. In Illinois, cannabis dispensary operators require <a href=\"https:\/\/cdn2.hubspot.net\/hubfs\/790303\/NCIA%20Committee%20White%20Papers\/FIC_InsuranceRequirementsFinal_digital.pdf\">$50,000 surety bonds<\/a> with the Illinois DFPR, Division of Professional Regulation as obligee. Cultivators also <a href=\"https:\/\/cdn2.hubspot.net\/hubfs\/790303\/NCIA%20Committee%20White%20Papers\/FIC_InsuranceRequirementsFinal_digital.pdf\">must provide evidence of financial responsibility<\/a> in the amount of at least $2,000,000, payable to the Department of Agriculture. Additionally, <a href=\"https:\/\/cdn2.hubspot.net\/hubfs\/790303\/NCIA%20Committee%20White%20Papers\/FIC_InsuranceRequirementsFinal_digital.pdf\">all Illinois employers<\/a> must provide workers\u2019 compensation coverage to employees.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\"><strong>The issues created by conflicting federal and state laws<\/strong><\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">Cannabis <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/21\/841\">remains illegal<\/a> under federal criminal law and is classified as a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/21\/812\">Schedule I<\/a> drug. Yet <a href=\"https:\/\/www.businessinsider.com\/legal-marijuana-states-2018-1#:~:text=Since%202012%2C%2015%20states%20and,marijuana%2C%20whether%20medically%20or%20recreationally.\">Illinois, 14 other states, and Washington, D.C<\/a>., have legalized the drug for recreational adult use. This has been made possible by the fact that federal prohibition and state permission does not automatically create a <a href=\"https:\/\/fas.org\/sgp\/crs\/misc\/R43034.pdf\">positive conflict<\/a> under the Tenth Amendment and preemption principles. Nonetheless, federalism still makes navigating banking and insurance regulations in the cannabis industry quite difficult.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">Cannabis businesses are required to operate on an <a href=\"https:\/\/www.marketplace.org\/2021\/02\/26\/will-congress-consider-giving-marijuana-companies-access-to-big-banks\/\">all-cash basis<\/a> and are unable to accept credit or debit cards due to federal banking law. This is because any contact with money that can be traced back to state cannabis operations is considered money laundering \u2013\u2013 a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1956\">federal crime<\/a> \u2013\u2013 <a href=\"https:\/\/www.aba.com\/advocacy\/our-issues\/cannabis\">exposing banks<\/a> to major legal and regulatory risks. Banking restrictions also indirectly affect cannabis businesses. Many national banks provide mortgages, which makes leasing space difficult. <a href=\"https:\/\/www.marketplace.org\/2021\/02\/26\/will-congress-consider-giving-marijuana-companies-access-to-big-banks\/\">Andy Grossman<\/a>, head of capital markets at an $8 billion cannabis business, explains it\u2019s \u201chard to find a landlord that doesn\u2019t have a mortgage with Wells Fargo\u2026and Wells Fargo says, \u2018Not in my building.\u2019\u201d<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">By the same token, many insurers, like banks, are <a href=\"https:\/\/www.insurancejournal.com\/news\/national\/2019\/03\/14\/520607.htmhttps:\/www.insurancejournal.com\/news\/national\/2019\/03\/14\/520607.htm\">unwilling to work<\/a> with cannabis companies due to conflicting federal and state laws. A <a href=\"https:\/\/www.newdawnrisk.com\/wp-content\/uploads\/2020\/05\/Cannabis_report-FINAL.pdf\">2020 report<\/a> from New Dawn Risk found that there are only six large insurers that offer cannabis coverage in the U.S. market. As a result, cannabis businesses must obtain insurance through <a href=\"https:\/\/www.newdawnrisk.com\/wp-content\/uploads\/2020\/05\/Cannabis_report-FINAL.pdf\">smaller state-based insurers<\/a>, which means coverage is limited and premiums are high. For instance, property coverage can cost as much as <a href=\"https:\/\/cannabisindustryjournal.com\/feature_article\/cannabis-property-coverage-understanding-risk-management-communication\/\">seven to ten times<\/a> what traditional manufacturers and retailers pay. The <a href=\"https:\/\/www.namic.org\/pdf\/publicpolicy\/181101cannabis.pdf\">primary challenge<\/a> in encouraging insurers to write coverage in this industry is the \u201clawful purpose\u201d requirement of a contract. Since cannabis is federally illegal, the <a href=\"https:\/\/content.naic.org\/sites\/default\/files\/inline-files\/cmte_c_cannabis_wg_exposure_understanding_cannabis_marketplace_0.pdf\">argument<\/a> may be made that the insurance policy is illegal and many insurers and re-insurers aren\u2019t willing to take that risk.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\"><strong>Lack of federal legalization inhibits growth and inflates risk<\/strong><\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">Between a general lack of willingness to insure cannabis businesses and inflated prices for those that do, growth in the industry is being inhibited. Capacity and rate issues would all but disappear with the federal legalization of cannabis. However, whether legalization will happen in the near future is <a href=\"https:\/\/www.politico.com\/news\/2020\/11\/29\/america-legalize-weed-congress-440718\">unclear<\/a>. Grossman <a href=\"https:\/\/www.marketplace.org\/2021\/02\/26\/will-congress-consider-giving-marijuana-companies-access-to-big-banks\/\">anticipates<\/a> that Congress will instead opt for piecemeal legislation that ameliorates some of the banking and insurance issues that cannabis businesses face.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif\">One example of this \u201cpiecemeal\u201d legislation is the <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/1595\/text\">Secure and Fair Enforcement (SAFE) Banking Act.<\/a> This bill would, among other things, prevent a\u00a0depository institution from being liable or subject to forfeiture\u00a0for providing\u00a0a loan or other\u00a0financial services to a legitimate marijuana-related business. Congress has also introduced the <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/2201?q=%7B%22search%22%3A%5B%22Clarifying+Law+Around+Insurance+of+Marijuana+%28CLAIM%29+Act%22%5D%7D&amp;s=1&amp;r=1\">Clarifying Law Around Insurance of Marijuana (CLAIM) Act<\/a>, which would generally provide a safe harbor from penalties or other adverse agency\u00a0action for\u00a0insurance\u00a0companies that provide services to cannabis-related businesses. The cannabis industry employs <a href=\"https:\/\/mjbizdaily.com\/chart-us-cannabis-employment-could-climb-nearly-50-in-2020-surpassing-computer-programmers\/#:~:text=The%20number%20of%20people%20working,employed%20in%20the%20United%20States.\">over 250,00 people<\/a> nationally and creates massive tax revenues for states where legalization has passed.
