{"id":2735,"date":"2019-12-23T18:39:34","date_gmt":"2019-12-24T00:39:34","guid":{"rendered":"http:\/\/blogs.luc.edu\/compliance\/?p=2735"},"modified":"2019-12-23T18:39:34","modified_gmt":"2019-12-24T00:39:34","slug":"facing-facial-recognition-technology","status":"publish","type":"post","link":"https:\/\/blogs.luc.edu\/compliance\/?p=2735","title":{"rendered":"Facing Facial Recognition Technology"},"content":{"rendered":"<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><i>Rachel Kemel<br \/>\nSenior Editor<br \/>\nLoyola University Chicago School of Law, JD 2020<\/i><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">In March 2019, Senator Brian Schatz and Senator Roy Blunt introduced a <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/847\/text?q=%7B%22search%22%3A%5B%22Commercial%20Facial%20Recognition%20Privacy%20Act%22%5D%7D&amp;r=1&amp;s=1&amp;source=post_page---------------------------\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">bill<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> to Congress designed to provide oversight for facial recognition technology, known as the Commercial Facial Recognition Privacy Act. If passed, this law could change the way Americans deal with privacy. <\/span><\/span><!--more--><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><b>What is the big deal about facial recognition technology? <\/b><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">Facial recognition technology is technology that has the ability to analyze the human face for the purpose of identifying them. A big issue surrounding such technology is the potential for discrimination. Amazon\u2019s technology, Rekognition, in particular faced <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.washingtonpost.com\/technology\/2019\/01\/25\/amazon-facial-identification-software-used-by-police-falls-short-tests-accuracy-bias-new-research-finds\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">backlash<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> when it misidentified people of color, and even in one test identified lawmakers as <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.nytimes.com\/2018\/07\/26\/technology\/amazon-aclu-facial-recognition-congress.html\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">criminals<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">.<\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">And recently, the American Civil Liberties Union <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.aclu.org\/news\/privacy-technology\/the-fbi-is-tracking-our-faces-in-secret-were-suing\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">sued<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> the FBI, the Department of Justice, and the Drug Enforcement Agency to get access to their records to determining if there is any secrete surveillance in use across the country. The American Civil Liberties Union argues that the only way there can be accountability is if there is transparency, and it has caused a debate as to what is private nowadays and what is not. <\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><b>What is the Commercial Facial Recognition Privacy Act?<\/b><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">The <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/847\/text?q=%7B%22search%22%3A%5B%22Commercial%20Facial%20Recognition%20Privacy%20Act%22%5D%7D&amp;r=1&amp;s=1&amp;source=post_page---------------------------\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">Commercial Facial Recognition Privacy Act<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> would require companies to receive explicit consent from customers before they are able to collect any such data, and it would limit companies from how they are able to share this data with third parties. Also, it would require there to be testing with human subjects before implementation as a way to eliminate any bias before release. The Act would also require companies to meet standards on data security, minimization, and retention as established by the Federal Trade Commission and the National Institute of Standards and Technology. <\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">Senator Schatz and Blunt <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.blunt.senate.gov\/news\/press-releases\/blunt-schatz-introduce-bipartisan-commercial-facial-recognition-privacy-act\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">argue<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> that their bill is necessary to protect the American people, because \u201c[o]ur faces are our identities. They\u2019re personal.\u201d However, the senators are not arguing against the use of such technology, in fact they even stated that it should continue to be developed as it will provide many benefits to society. But its use must be regulated \u201cto protect against acts of bias and discrimination, preserve consumer privacy, and uphold our basic democratic freedoms.\u201d<\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><b>Why pass such a bill?<\/b><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">A benefit of this bill is that it will help consolidate facial recognition rules across states. Currently, the landscape for these types of laws is all over the place. Portland, Oregon will soon be holding a <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.koin.com\/news\/civic-affairs\/portland-plan-to-ban-facial-recognition-gets-eyes-around-us\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">public meeting<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> to decide whether it wishes to block use of such technology by not only private companies, but also the government. Cities in <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.wired.com\/story\/san-francisco-bans-use-facial-recognition-tech\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">California<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> have already instituted a ban on the use of facial recognition technology by their city agencies, while Detroit only allows the use when it is in connection with <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/detroit-police-can-keep-using-facial-recognition-limits-n1056706\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">investigation<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> of violent crimes and home invasions, but they are not <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/detroit\/2019\/09\/19\/detroit-police-facial-recognition-policy-approved\/2374839001\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">allowed<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> to use live or recorded video, nor use it to assess a person&#8217;s immigration status<\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><b>Would any companies be happy with this?<\/b><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">In December, Microsoft president Brad Smith released a <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/blogs.microsoft.com\/on-the-issues\/2018\/12\/06\/facial-recognition-its-time-for-action\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">statement<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> saying that Microsoft was in favor of such a bill, that it is \u201cimportant for governments in 2019 to start adopting laws to regulate this technology\u201d. Facial recognition is such new technology, that no one really knows where it is going, and Microsoft argues that it is best to act now unless we wish to \u201crisk waking up five years from now to find that facial recognition services have spread in ways that exacerbate societal issues.\u201d And by that point in time, the issues will be \u201cmore difficult\u201d to battle than if they are tried to combat early on. Microsoft even went on to say that technology companies should not wait for this bill to pass, that it is their responsibility to start creating safeguards for the people. To do so, Microsoft promised to release new materials and training resources to their customers. <\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">Microsoft even <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.seattletimes.com\/business\/microsoft-backs-washington-states-facial-recognition-bill-as-amazon-mulls-support\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">lobbied<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> for a bill in Washington, its home state, that would <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/www.seattletimes.com\/seattle-news\/politics\/should-washington-state-adopt-european-style-data-privacy-laws-some-lawmakers-say-yes\/\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">bring<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> \u201cEuropean-style privacy and transparency regulations.\u201d Currently, the European Union has the <\/span><\/span><span style=\"color: #0563c1\"><u><a href=\"https:\/\/ec.europa.eu\/info\/priorities\/justice-and-fundamental-rights\/data-protection\/2018-reform-eu-data-protection-rules\/eu-data-protection-rules_en\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">General Data Protection Regulation<\/span><\/span><\/a><\/u><\/span><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"> which details citizens\u2019 individual rights and requires companies to ask permission before gathering such data.<\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\"><b>The future of the Bill<\/b><\/span><\/span><\/p>\n<p class=\"western\"><span style=\"font-family: Times New Roman, serif\"><span style=\"font-size: medium\">The bill has been referred to the Committee on Commerce, Science, and Transportation. Whether it will go forward and require companies to limit their actions is still in the air but having a foundation for future legislation would likely be beneficial as facial recognition technology continues to become prevalent in society. <\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In March 2019, Senator Brian Schatz and Senator Roy Blunt introduced a bill to Congress designed to provide oversight for facial recognition technology, known as the Commercial Facial Recognition Privacy Act.
