{"id":2667,"date":"2019-11-12T22:05:38","date_gmt":"2019-11-13T04:05:38","guid":{"rendered":"http:\/\/blogs.luc.edu\/compliance\/?p=2667"},"modified":"2019-11-12T22:05:38","modified_gmt":"2019-11-13T04:05:38","slug":"as-cbd-sales-grow-the-ftc-cautions-against-misrepresentations","status":"publish","type":"post","link":"https:\/\/blogs.luc.edu\/compliance\/?p=2667","title":{"rendered":"As CBD Sales Grow, FTC Cautions Against Misrepresentations"},"content":{"rendered":"<p><em>Haley Burridge<\/em><\/p>\n<p><em>Associate Editor<\/em><\/p>\n<p><em>Loyola University Chicago School of Law, JD 2021<\/em><\/p>\n<p>On September 10, 2019 the Federal Trade Commission (FTC) sent <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">warning<\/a> letters to three companies that sell oils, tinctures, capsules, \u201cgummies,\u201d and creams containing cannabidiol (CBD) regarding the companies\u2019 false advertising practices. <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">Cannabis<\/a> is a plant of the Cannabaceae family and contains more than eighty biologically active chemical compounds. The most commonly known <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">compounds<\/a> are delta-9-tetrahydrocannabinol (THC) and cannabidiol (CBD). <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-approves-first-drug-comprised-active-ingredient-derived-marijuana-treat-rare-severe-forms\">CBD<\/a> does not cause intoxication like THC.<\/p>\n<p><!--more--><\/p>\n<p><strong>Legalization of cannabidiol (CBD)<\/strong><\/p>\n<p>The <a href=\"https:\/\/www.mayoclinicproceedings.org\/article\/S0025-6196(19)30007-2\/fulltext\">1970<\/a> Controlled Substances Act outlawed the growing and selling of hemp and marijuana, and hemp remained illegal to grow in the United States until the passage of the 2014 Agricultural Act. The 2014 Agricultural Act made a legal <a href=\"https:\/\/www.mayoclinicproceedings.org\/article\/S0025-6196(19)30007-2\/fulltext\">distinction<\/a> between hemp and marijuana for the first time. It <a href=\"https:\/\/www.mayoclinicproceedings.org\/article\/S0025-6196(19)30007-2\/fulltext\">defined<\/a> \u201cindustrial hemp\u201d as \u201cCannabis sativa L. and any part of such plant, whether growing or not, with a delta-9-THC content of no more than 0.3% on dry weight basis.\u201d Since the passage of the 2014 Agricultural Act, the total U.S. CBD consumer sales have <a href=\"https:\/\/www.statista.com\/statistics\/760498\/total-us-cbd-sales\/\">grown<\/a> from $108.1 million to $512.7 million in 2018. It is <a href=\"https:\/\/www.statista.com\/statistics\/760498\/total-us-cbd-sales\/\">expected<\/a> that U.S. consumer sales of CBD will reach around $1.8 billion by 2022.<\/p>\n<p>On December 20, 2018, President Trump signed the Agriculture Improvement Act of 2018, also known as the 2018 Farm Bill, into law which <a href=\"https:\/\/www.perkinscoie.com\/en\/news-insights\/what-does-the-2018-farm-bill-mean-for-the-hemp-and-cbd-businesses.html\">legalized <\/a>the cultivation and sale of hemp at the federal level. Unlike marijuana, hemp contains minimal concentrations of tetrahydrocannabinol (THC), the chemical that produces psychoactive <a href=\"https:\/\/www.perkinscoie.com\/en\/news-insights\/what-does-the-2018-farm-bill-mean-for-the-hemp-and-cbd-businesses.html\">effects.<\/a> Under the 2018 Farm Bill, hemp products containing less than 0.3% of THC, are not mandated to undergo clinical evaluations before going to <a href=\"https:\/\/www.forbes.com\/sites\/daviddisalvo\/2019\/08\/26\/the-cbd-market-is-red-hot-but-safety-and-efficacy-evidence-is-still-lacking-experts-argue\/#45e38c11d232\">market.<\/a> \u00a0It is illegal to sell or consume CBD and hemp oils in Idaho, South Dakota, and Nebraska. However, in all of the other <a href=\"https:\/\/www.mayoclinicproceedings.org\/article\/S0025-6196(19)30007-2\/fulltext\">states<\/a>, CBD and hemp oils are legal as long as the THC content is below the 0.3% threshold.<\/p>\n<p><strong>FDA approval of cannabis-derived and cannabis-related drug products<\/strong><\/p>\n<p>As of October <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">2019<\/a>, the FDA has approved one-cannabis derived and three cannabis-related products, which are available to individuals with a prescription from a licensed healthcare provider.<\/p>\n<p>In June 2018, the first CBD-based drug, Epidiolex, was approved by the U.S. Food and Drug Administration (<a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-approves-first-drug-comprised-active-ingredient-derived-marijuana-treat-rare-severe-forms\">FDA<\/a>) for treatment of seizures associated with two rare and severe forms of epilepsy, Lennox-Gastaut syndrome and Dravet syndrome, in patients two years of age and older. Epidiolex is the first <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-approves-first-drug-comprised-active-ingredient-derived-marijuana-treat-rare-severe-forms\">FDA-approved<\/a> drug that contains a purified drug substance derived from marijuana, and it is the first FDA-approved drug for the treatment of patients with Dravet syndrome. <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">Epidiolex<\/a> remains the only FDA-approved drug product that contains CBD.<\/p>\n<p>The FDA also has <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">approved<\/a> Marinol and Syndros for therapeutic uses in the United States, including for the treatment of anorexia associated with weight loss in AIDS patients. They <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">include<\/a> the active ingredient dronabinol, a synthetic delta-9- tetrahydrocannabinol (THC) which is considered the psychoactive component of cannabis. Another FDA-approved drug, Cesamet, <a href=\"https:\/\/www.fda.gov\/news-events\/public-health-focus\/fda-regulation-cannabis-and-cannabis-derived-products-including-cannabidiol-cbd\">contains<\/a> the active ingredient nabilone, which has a chemical structure similar to THC and is synthetically derived.<\/p>\n<p><strong>FTC\u2019s warning letters<\/strong><\/p>\n<p>The FTC\u2019s warning <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">letters<\/a> stated that it is illegal to advertise that CBD can prevent, treat, or cure human disease without reliable scientific evidence to support such claims. The FTC is not <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">publicly identifying <\/a>the three companies. The first <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">company<\/a> claimed on its website that CBD relieves chronic pain better than prescription opioid painkillers. It also <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">stated<\/a> that CBD has been \u201cclinically proven\u201d to treat various diseases such as cancer, Alzheimer\u2019s disease, multiple sclerosis, fibromyalgia, cigarette addiction, and colitis, and that is has participated in \u201cthousands of hours of research\u201d with Harvard researchers.<\/p>\n<p>The second <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">company<\/a> stated on its website that CBD products are proven to treat autism, anorexia, bipolar disorder, post-traumatic stress disorder, schizophrenia, anxiety, depression, Alzheimer\u2019s disease, Lou Gehrig\u2019s Disease (ALS), stroke, Parkinson\u2019s disease, epilepsy, traumatic brain injuries, diabetes, Crohn\u2019s disease, psoriasis, MS, fibromyalgia, cancer, and AIDS.<\/p>\n<p>Finally, the <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">third<\/a> company\u2019s website promotes CBD gummies as highly effective at treating \u201cthe root cause of most major degenerative diseases, including arthritis, heart disease, fibromyalgia, cancer, asthma, and a wide spectrum of autoimmune disorders.\u201d It also <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">claims<\/a> its CBD cream relieves arthritis pain and that its CBD oil may effectively treat depression, PTSD, epilepsy, heart disease, arthritis, fibromyalgia, and asthma.<\/p>\n<p><strong>Potential for future legal action <\/strong><\/p>\n<p>The FTC urges the companies to review all claims made for their products, including consumer testimonials, to ensure they are supported by competent and reliable <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">scientific evidence.<\/a> The letters also warn that selling CBD products without such substantiation could violate the FTC Act and may result in <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">legal action<\/a> that could result in an injunction and an order to return money to consumers. The companies are instructed to <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2019\/09\/ftc-sends-warning-letters-companies-advertising-their-cbd-infused\">notify<\/a> the FTC within 15 days of the specific actions they have taken to address the agency\u2019s concerns.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On September 10, 2019 the Federal Trade Commission (FTC) sent warning letters to three companies that sell oils, tinctures, capsules, \u201cgummies,\u201d and creams containing cannabidiol (CBD) regarding the companies\u2019 false advertising practices.
