The ACA introduced Administrative Simplification provisions in 2010 and now the <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Subregulatory-Guidance\/Downloads\/CRProgramInformationBulletin.pdf\">Centers for Medicaid and Medicare Services (CMS) has launched a Compliance Review Program<\/a> to ensure that HIPAA covered entities are abiding by the Administrative Simplification rules.<\/p>\n<p><!--more--><\/p>\n<p class=\"Normal1\"><b>Selection Process<\/b><\/p>\n<p class=\"Normal1\">Starting in April 2019, the <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Subregulatory-Guidance\/Downloads\/CRProgramInformationBulletin.pdf\">Department of Health and Human Services (HHS) will randomly select nine HIPAA-covered entities<\/a> for Compliance Reviews.The nine HIPAA-covered entities can be chosen from <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Enforcements\/Compliance-Review-Program.html\">any health plan or clearinghouse<\/a>, not only those who bill CMS. HHS will be evaluating the chosen HIPAA-covered entities\u2019 compliance with standards for electronic transactions, code sets, and unique identifiers.<\/p>\n<p class=\"Normal1\"><b>Compliance Standards<\/b><\/p>\n<p class=\"Normal1\">A <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Transactions\/TransactionsOverview.html\">transaction is defined<\/a>as an \u201celectronic exchange of information between two parties to carry out administrative activities related to health care.\u201d <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Transactions\/TransactionsOverview.html\">HIPAA-covered entities who conduct transactions<\/a> such as, but not limited to, claims and encounter information, claims status, coordination of benefits, and referrals and authorizations must use an adopted standard from <a href=\"http:\/\/www.x12.org\/\">ASC X12N<\/a> or <a href=\"https:\/\/www.ncpdp.org\/Resources\/HIPAA-Information\">NCPDP<\/a>. <a href=\"http:\/\/www.x12.org\/about\/asc-x12-about.cfm\">ASC X12N<\/a> is charted by the American Standards Institute and establishes electronic data interchange standards. <a href=\"https:\/\/ncpdp.org\/Standards-Development\/Standards-Information\">NCPDP<\/a> creates standards for prescription drug transactions.<\/p>\n<p class=\"Normal1\"><a href=\"http:\/\/a\/\">Code sets classify<\/a>medical diagnoses, procedures, diagnostic tests, treatments, and equipment and supplies. Code sets included in HIPAA regulations include the <a href=\"https:\/\/www.cms.gov\/Medicare\/Coding\/ICD10\/\">International Classification of Diseases, 10th edition<\/a> (ICD-10), <a href=\"https:\/\/www.cms.gov\/Medicare\/Coding\/MedHCPCSGenInfo\/HCPCSCODINGPROCESS.html\">Health Care Common Procedure Coding System<\/a> (HCPCS), <a href=\"https:\/\/www.ama-assn.org\/practice-management\/cpt-current-procedural-terminology\">Current Procedure Terminology<\/a> (CPT), <a href=\"http:\/\/www.ada.org\/en\/publications\/cdt\/\">Code on Dental Procedures and Nomenclature<\/a> (CDT), and <a href=\"http:\/\/www.fda.gov\/Drugs\/InformationOnDrugs\/ucm142438.htm\">National Drug Codes<\/a> (NDC).<\/p>\n<p class=\"Normal1\">HIPAA requires unique identifiers including <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Unique-Identifier\/HPID.html\">Health Plan Identifiers<\/a> (HPIDs), <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Unique-Identifier\/EIN.html\">Employer Identification Numbers<\/a> (EINs) that are issued by the Internal Revenue Service (IRS), and <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Unique-Identifier\/NPIs.html\">National Provider Identifier<\/a> (NPI).<\/p>\n<p class=\"Normal1\"><a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/HIPAA-ACA\/index.html\">CMS\u2019 position<\/a> is that enforcing the Administrative Simplification requirements is \u201cessential to ensuring the health care community reaps the benefits of standardized transactions and reduced administrative costs.\u201d CMS <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/HIPAA-ACA\/index.html\">argues that electronic communications can help ease administrative burdens<\/a> on health care providers and result in a faster revenue cycle.<\/p>\n<p class=\"Normal1\"><b>Analysis of Compliance<\/b><\/p>\n<p class=\"Normal1\">The <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Subregulatory-Guidance\/Downloads\/CRProgramInformationBulletin.pdf\">HIPAA-covered entities will be evaluate<\/a>d by whether they comply with operating rules. The <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Operating-Rules\/OperatingRulesOverview.html\">operating rules are required by the ACA<\/a> and are defined as \u201cthe necessary business rules and guidelines for the electronic exchange of\u00a0 information that are not defined by a standard or its implementation specifications.\u201d<\/p>\n<p class=\"Normal1\">Entities that are found to be noncompliant will be <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Subregulatory-Guidance\/Downloads\/CRProgramInformationBulletin.pdf\">given a chance<\/a> to correct their issues. However, if the covered entities remain non compliant, they will be <a href=\"https:\/\/www.cms.gov\/Regulations-and-Guidance\/Administrative-Simplification\/Subregulatory-Guidance\/Downloads\/CRProgramInformationBulletin.pdf\">subject to enforcement actions<\/a>.<\/p>\n<p class=\"Normal1\"><b>Assessing Electronic Health Records<\/b><\/p>\n<p class=\"Normal1\">Although touted to be a way to reduce administrative burden, transitioning from paper to electronic health records <a href=\"https:\/\/ehrintelligence.com\/news\/ehr-adoption-unsuccessful-in-reducing-administrative-costs\">may not reduce this burden as much as promised<\/a>. Additionally, <a href=\"https:\/\/www.beckershospitalreview.com\/finance\/researchers-say-ehr-adoption-doesn-t-cut-hospital-billing-costs-5-study-findings.html\">five studies have<\/a> found that electronic health record adoption does not translate to a reduction in hospital billing costs. At the same time, however, electronic health records <a href=\"https:\/\/www.beckershospitalreview.com\/finance\/researchers-say-ehr-adoption-doesn-t-cut-hospital-billing-costs-5-study-findings.html\">may improve the diagnostic process<\/a>.
