What prompts this gift? A belief that we all bear responsibility for sustaining a functional economy.\u00a0 At\u00a0a time when some corporate leaders and their legal teams focus on the perils of overregulation, the greatest regulatory risk an enterprise confronts may not be high compliance hurdles, but rather the possibility that regulators can&#8217;t keep the economy functioning well enough for the enterprise to do its most commercially inventive and societally valued work.<\/p>\n<p><strong>Regulatory truth<\/strong><\/p>\n<p>There is no law that requires a healthy economy be here for us to capitalize on tomorrow morning when we wake up. <a href=\"https:\/\/www.apple.com\/leadership\/tim-cook\/\">Apple\u2019s Tim Cook<\/a> apparently knows this. In Andrew Ross Sorkin\u2019s recent\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/08\/28\/business\/dealbook\/tim-cook-apple-moral-responsibility.html?mcubz=0\">New York Times piece<\/a>, Cook states, \u201cI think we have a moral responsibility to help grow the economy.\u201d<\/p>\n<p>Why does this responsibility fall to us? \u201c[G]overnment, for a long period of time, has for whatever set of reasons become less functional and isn\u2019t working at the speed that it once was.\u201d<\/p>\n<p>He seems\u00a0to have no interest in complaining. Perhaps that&#8217;s because he is focused on an unexpected point\u2014at a time when some corporate leaders <a href=\"http:\/\/www.pwc.com\/gx\/en\/ceo-survey\/2017\/pwc-ceo-20th-survey-report-2017.pdf\">focus on the perils of overregulation<\/a>, the greatest regulatory risk an enterprise confronts may not be high compliance hurdles, but rather the possibility that regulators can&#8217;t keep the economy functioning well enough for the enterprise to do its most commercially inventive and societally valued work.<\/p>\n<p>Despite regulators\u2019 best efforts, for example, a company like Apple may find that:<\/p>\n<ul>\n<li>Land use policies may not be effective enough to prevent outsized demand from rocketing urban housing costs so high that employees with mission-critical skills <a href=\"http:\/\/sanfrancisco.cbslocal.com\/2017\/07\/27\/bay-area-traffic-up-4am-bay-bridge-san-mateo-richmond-san-rafael\/\">must drive several hours per day<\/a> to commute to work, which may damage both employee and company productivity.<\/li>\n<li><a href=\"https:\/\/www.nytimes.com\/2017\/08\/25\/us\/politics\/yellen-warns-against-erasing-regulations-made-after-the-financial-crisis.html\">Financial regulations<\/a> may become so politically toxic that they are abolished, leaving less defense against a mix of corporate malpractice and consumer naivet\u00e9 that could produce the next recession and drive company customers out of business.<\/li>\n<li><a href=\"http:\/\/www.acenet.edu\/news-room\/Documents\/Higher-Education-Regulations-Task-Force-Report.pdf\">Federal education regulations<\/a> may not be aggressive enough to incentivize higher education to improve university graduation rates from today\u2019s <a href=\"https:\/\/nces.ed.gov\/fastfacts\/display.asp?id=40\">anemic 59% rate<\/a>, which leaves too small a pool of qualified prospects from which to fill posts that the company, its suppliers and its competitors need to fill.<\/li>\n<li><a href=\"https:\/\/www.washingtonpost.com\/world\/china-to-use-all-necessary-means-to-defend-itself-against-trump-protectionism\/2017\/08\/24\/d0445ec1-9b07-40d4-aaf5-94f8235bef7b_story.html?utm_term=.b25dfb5d0bfd\">International trade<\/a> agreements and accords that are beyond regulators\u2019 control may be mismanaged into collapse, effectively cutting off the company from, say, European or Asian suppliers and customers.<\/li>\n<li><a href=\"https:\/\/www.forbes.com\/sites\/johnmauldin\/2016\/07\/05\/3-reasons-brits-voted-for-brexit\/\">Nationalism-driven shifts<\/a> in government policy, again beyond regulators\u2019 control, may also thwart the company\u2019s ability to transact with suppliers and customers from around the globe.<\/li>\n<\/ul>\n<p><strong>Apple invests<\/strong><\/p>\n<p>Given that regulators may indeed have \u201cfor whatever set of reasons become less functional\u201d in their ability to sustain the economy, how is Apple choosing to pick up the slack?\u00a0 Education.<\/p>\n<p>The company\u2019s new curriculum, released in May, teaches community college students to write code to create apps. It is being offered directly by 30 schools around the country in the 2017-18 academic year. The curriculum focuses on the Swift programming language, which Apple <a href=\"https:\/\/gigaom.com\/2014\/06\/03\/developers-are-cautiously-excited-about-apples-new-swift-programming-language\/\">debuted in 2014<\/a> as its preferred method for third-party developers to build apps for devices like the iPhone and MacBook computers. It builds on Apple\u2019s prior educational initiatives for younger students, such as <a href=\"https:\/\/www.apple.com\/swift\/playgrounds\/\">Swift Playgrounds<\/a> and the <a href=\"https:\/\/www.apple.com\/everyone-can-code\/\">Everyone Can Code program<\/a>, a K-12 curriculum to teach the next generation the coding skills that will be necessary in future job markets.<\/p>\n<p>What\u2019s the upside? For students, the curriculum cultivates talents that will enable them to take a valued role in the economy, writing apps for Apple or other sophisticated new media companies.\u00a0For Apple, the curriculum expands the pool of accomplished programmers from which it can hire, and increases the chances that there will be innovative iPhone apps on which it can someday profit.<\/p>\n<p>And for the nation more broadly, the Swift curriculum&#8217;s rollout addresses what the Apple CEO calls a \u201cgeographic diversity\u201d issue: \u201cRight now, the benefits of tech are too lop-sided to certain states.\u201d The Swift curriculum is being offered not just at schools in high tech hotbeds\u2014e.g., Austin City College.\u00a0 It is also being offered <a href=\"https:\/\/www.apple.com\/newsroom\/2017\/08\/leading-us-community-colleges-adding-swift-curriculum\/\">at schools in\u00a0Kansas, Alabama and Mississippi<\/a>, which means it will help fuel growth in regions that have been bypassed by tech\u2019s benefits in the past.<\/p>\n<p><strong>Intelligent play<\/strong><\/p>\n<p>Is Cook correct in believing that this sort of economy-sustaining initiative is a \u201cmoral responsibility\u201d?<\/p>\n<p>Some will say no. They will argue that the Swift initiative lies well beyond the bounds of the traditional definition of capitalism, and well beyond the bounds of Apple\u2019s legal duties, so Cook and Apple are wasting resources. In particular they may reject the idea that there could possibly be a \u201cmoral\u201d element to sustaining an economy.<\/p>\n<p>Set aside the morality debate, though, and what\u2019s going on here? \u00a0Cook and Apple are making an intelligent play.<\/p>\n<p>They have figured out that a strong economy is not guaranteed to them, especially today, when the cocktail of <a href=\"https:\/\/www.nytimes.com\/interactive\/2017\/08\/07\/opinion\/leonhardt-income-inequality.html\">income<\/a> <a href=\"https:\/\/www.washingtonpost.com\/news\/rampage\/wp\/2017\/08\/11\/why-income-inequality-is-so-much-worse-in-the-u-s-than-in-other-rich-countries\/?utm_term=.df7cbb297045\">inequality<\/a> and <a href=\"https:\/\/www.theguardian.com\/politics\/2017\/jul\/17\/uk-business-confidence-britain-economic-growth-brexit-anxiety\">macroeconomic<\/a> <a href=\"https:\/\/www.nytimes.com\/2017\/08\/27\/us\/politics\/bankers-and-economists-fear-a-spate-of-threats-to-global-growth.html?rref=collection%2Ftimestopic%2FUnited%20States%20Economy&amp;action=click&amp;contentCollection=timestopics&amp;region=stream&amp;module=stream_unit&amp;version=latest&amp;contentPlacement=5&amp;pgtype=collection\">uncertainty<\/a> that <a href=\"https:\/\/www.reuters.com\/article\/us-usa-trump-russia-retaliation-economy\/fragile-economy-stays-putins-hand-in-stand-off-with-u-s-idUSKBN1AH4S1\">afflicts<\/a> <a href=\"https:\/\/lab.org.uk\/mexico-trump-weakens-fragile-economy\/\">so many<\/a> nations around the globe makes the economy more fragile than we might suspect.<\/p>\n<p>They have figured out how to generate <a href=\"https:\/\/www.apple.com\/newsroom\/2017\/05\/apple-reports-second-quarter-results\/\">enterprise success<\/a>\u2014Apple earned $52.9 billion in revenue in Q2 2017\u2014and at the same time cultivate everyone\u2019s economic future, their own included.<\/p>\n<p>They have figured out that there is payoff in asking, <em>how can we help the economy function?<\/em><\/p>\n<p>Anyone who wants to be taken seriously as a global economic leader today needs to be asking this question.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/wdesquire.com\/\"><em>William Devine<\/em><\/a><em> runs a regulatory law practice in Silicon Valley and is Adjunct Professor of Management at Menlo College.<\/em><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>by William Devine, Guest Contributor<\/p>\n<p>Apple has developed and distributed a curriculum that will teach students at 30 community colleges around the country to write code and create apps.
